This will effectively ban all reptile and bird shows and any other animal show from being held in Nevada.
ASSEMBLY BILL NO. 246ˤOMMITTEE ON NATURAL RESOURCES, AGRICULTURE, AND MINING MARCH 13, 2013 ____________ Referred to Committee on Natural Resources, Agriculture, and Mining SUMMARYͱrohibits the sale or transfer of ownership of a live animal at a swap meet. AN ACT relating to animals; prohibiting the sale or transfer of ownership of a live animal at a swap meet; providing an exception; providing a penalty; and providing other matters properly relating thereto. Legislative CounselÃÔ Digest: 1 This bill prohibits a person, other than a nonprofit organization that was formed 2 for animal welfare purposes, from selling, attempting to sell, offering for adoption 3 or transferring ownership of a live animal at a swap meet. A person who violates 4 that prohibition is guilty of a misdemeanor. This bill also requires a nonprofit 5 organization which sells a live animal or offers a live animal for adoption to 6 provide proof that the animal has been sterilized and that the animalÃÔ 7 immunizations are current. THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: 1 Section 1. Chapter 574 of NRS is hereby amended by adding 2 thereto a new section to read as follows: 3 1. A person who sells or attempts to sell, offers for adoption 4 or transfers ownership of a live animal at a swap meet is guilty of 5 a misdemeanor. 2 - *AB246* 1 2. The provisions of this section do not apply to a bona fide 2 nonprofit organization formed for animal welfare purposes that 3 sells or offers for adoption a cat, dog or rabbit at a swap meet. For 4 each animal sold or offered for adoption, the nonprofit 5 organization shall, upon request by the operator of the swap meet, 6 a law enforcement officer or an officer of a society for the 7 prevention of cruelty to animals who is authorized to make arrests 8 pursuant to NRS 574.040, provide the appropriate documentation, 9 including, without limitation, a record of current immunizations 10 and proof that the animal has been sterilized. 11 3. As used in this section: 12 (a) Å´ell means to barter, exchange, sell, trade, offer for sale, 13 expose for sale, have in possession for sale, arrange the sale of or 14 solicit for sale. 15 (b) Å´wap meet means a flea market, open-air market or 16 other organized event at which two or more persons offer 17 merchandise for sale or exchange.
