So long as it's not attacking you, I would keep it. Maybe put it in like a little card board box with a stuffed animal or something. If you don't feel comfortable with that, take it to a no-kill shelter. Being 5 wks old, I doubt it'll be able to survive on it's own.
I was too in your position. I found a kitten along side the road, but he wasn't scared and he was very friendly, so he immediately stole my heart. About a year later, I found another one, but it was completely feral and wild. I successfully caught it and attempted to feed it and whatnot but it continually tried to attack me so I just let it go. I felt bad for not doing more, but I wasn't about to keep a critter that was out to draw blood.
