A Greenwich man is appealing his conviction on a charge of illegal posession of a reptile.
In a newly-released decision, the state appellate court has now sent the case back to a lower court for an evidentiary hearing.
The state appellate court writes that Greenwich Police found the lizard during a warrantless search in 2004.
Investigators went to Gary Ryder's home looking for a missing adolecent, and entered the house through an unlocked back door.
In a second floor bathroom, an officer looked through a frosted glass door, and saw a dark figure in a tub.
Thinking the figure might be the child, the officer opened the door and found a large lizard, that looked like a crocodile.
Ryder later paid a 35-dollar fine, for illegal posession of a reptile, but the judge at the time told him he could appeal.
