I Tried Returning it but they are lingering on technicalities!!!

I phoned them up and told them i wanted to return it because of the missing toe and they said there is only a health warranty so only if it dies or it is something to do with the health of the animal i didnt want to say its was too skinny or something because i did not know how to say it and i didnt want to blow my chance of returning it



Can someone help me? What do i say? how can i convince them?PLZZZZZZZZ
