If he's alert and active, it could just be parasites. If he's lethargic and "dull", you could have a problem. If that's the case, make a bigger fuss and they'll probably take him back - but focus on the lethargy, etc rather than the toe. They might just think you're being a snob about his appearance. If he's alert, I wouldn't worry about it so much - take him to the vet for treatment of parasites and a checkup, keep him warm, and feed him well and he should hopefully be fine.
