Depends which country you're in, but in England they would have to take him back, having said that I always get instantly attached to the animals I buy so I would always take them to a vet before I did anything else. Remember to be assertive though if you really think they have deliberately sold you a sick animal insist on speaking to the manager and tell him or her that you want to exchange him for another. I'm sorry if we've all made you feel bad, it's possible that your lizard will be fine with some tlc.
