A9988/S6903: If you sell 25 or more animals per year you will be defined as a pet dealer, need a license currently $100 per
year, there are paperwork requirements, mandatory inspections, as well as standards not applicable to rabbits. Bans sale of exotic and wild animals. States inpsectors must be trained but does not define who trains and using what materials which means ARAs can get involved. In Agriculture committee

Arguments Against:
-Number assigned to define a pet dealer is the same originally applied todog and cat dealers, this is arbitrary and not based on real numbers sold by hobby breeders of other species. Example hobby show rabbit breeders sell 50-100.
-Breeder licensing is undesirable, commercial breeders are already licensed by the USDA, hobby breeder licensing leads to undue hardship in the form of additional fees, paperwork, mandatory inspections
-Bill badly written with requirements not applicable to accepted husbandry standards or any that deal with each specific species
-Current law system to correct violations by pet dealers non-existent, they just report them to local SPCA who then confiscates all the animals and arrests the dealer. There is clear evidence that NYS SPCAs empowered to conduct cruelty investigations are anti-breeder.

This bill is loaded with problems, it creates a new law-endangering the welfare of an animal. It mandates veterinary care but does not define it. This means anytime any animal is not in a state of 100% "good health" you are required to seek veterinary treatment. This means your pet has fleas-you have to go to the vet, animal breaks a toenail-have to go to the vet, you get the idea. Current law provides for medical care-given by owner is sufficient if they are able to. State of good health is defined as "freedom from disease and illness and in a condition of proper body weight and temperature for the age and species of animal unless such animal is undergoing appropriate treatment for a disease or illness". As most rabbit breeders treat at home this law would make us criminals. Also it makes you guilty of this crime if there is a "risk" that the animal "is or will be" deprived of food, water, vet
care, etc. So if a corrupt ACO thinks the animal "might be" they can arrest you and take your animal. This section is just insane and violates due process and constitutional rights.Keep in mind current NYS law is wide open to interpretation and many ACOs are interpreting things in the wrong way thereby arresting innocent people and seizing their animals. We need to tighten the law not create more problems.
A2753: Expands Ag & Mrkts 373 allowing ACOs to seize and adopt out animals, this bill violates due process for owners, it allows for seizure and adoption of animals without a court hearing, does not allow return of animal unless the accused is acquitted of ALL charges. In Agriculture committee

-There is a difference between an "intentional" act of cruelty and one where someone acts "recklessly" thereby causing injury or death. The public wishes to see intentional acts punished but realize one can act "recklessly" and cause unintended results, the two are very different and should not hold the same level of punishment.
