Filter Problem

My ten gallon tank has a filter that I used for fish previously. Im making my tank a newt tank now. Well the problem is that the water needs to go pretty high for it to work so I only have less then 3.5 inches of space left for land. What should I do? And is it ok if the light on the tank cover is really close to the land piece?
