CA AB 2862 update

AB 2862 has been amended once again.

The ban on the sale of unweaned rodents has been removed.

The ban on lawfully bred California species has ben removed.

Text of the amended bill

Problems remaining:

Privacy issues with respect to buyers and breeders information. Why should JOey have to give me his information everyweek when he buys a mouse to feed his snake? If he breeds his snake why should I be forced to put his information on the wall?

Rodent cage size. Four mice per square foot is too sparse for the comfort of the mice themselves. They prefer the safety of numbers. The law actually is harmful to the animals it purports to pretects.

The battle is far from over.

Keep sending letters or getting flyers signed. Tell your friends and colleagues.

Progress is being made!

Since the unweaned mice has been removed, does that also mean the ban on all pets under 8 weeks is also removed?

It's just like the story of the grasshopper and the octopus. All year long the grasshopper stored up acorns for winter, while the octopus mooched off his girlfriend and watched tv. And then the winter came, and the grasshopper died, and the octopus stole all his acorns, and he got a race car. Is any of this sinking in?

NO. Please read the link in my previous post. It excludes feeder rodents from from the un-weaned animal ban.

PROBLEMS WITH THE BILL REMAINING:
Privacy issues withg buyers having to provide name address and telephone number foe every animal purchase.

Business privacy issues with businesses having to post vendors name address and phone number.

Cookie cutter caging for birds that may be bad for the birds.

Cage size requirements for feeder rodents.

Argument for feeder rodent cage sizes:

Feeder rodents are a prey species. As such they feel safety in numbers. What may seem like crowded conditions is really a safe haven and comfortable environment for the mice and rats. Spread them out into sparse cage as the bill requires and they will still cower, crowded into a small space.

RECOMMENDED ACTION:
Write letters to the Business and Professions Committee members , your assemblymember and the Governor. Get family friends and coleagues to do the same. If you are a pet store make a flyer spelling out the problems with this bill. Make another flyer for people to sign.

A letter I have been sending to privacy advocates in an effort to get them on board:

California Assembly bill AB 2862 attempts to put pet store management into Penal Code making criminals of previously law abiding, tax paying small business owners.

Among various pet store management criteria the state seems to want to know who is buying what animals. The measure will require pet stores to collect name address and telephone numbers of all animal buyers AND MAKE IT AVAILABLE TO THE AUTHORITIES FOR ONE YEAR. What exactly does the state want this info for? Why treat folks buying a mouse for snake food or a pet hamster as if they were buying some dangerous product?

Further, the stores will also be required TO POST IN A PUBLIC PLACE the name address and phone numbers of their VENDORS. Making public important proprietary business information, including that of little kids that breed pets for a hobby.

This bill must be stopped.

Thanks for all your hard work in this area. Some of this is just insane, making a customer give personal information to buy a pet or feeder. How would PETA like it if there was a law that said that said all vegetarians had to where a special patch on their clothes so they could be identified by the government.
I thought that type of thing had already been tried and most of the world didn't like it too much.
If this law passes what is going to prevent PETA from getting personal info doing marches or even vandalising the homes of pet owners, they have done it to public figures.

I am sure they would love it. Sicialism at it's best.

Because this Business and Professions commeittee meeting is the day after Easter few folks can actually go.

We are trying to get the hearing changed to another date.

Call the author Mark Ridley-Thomas' office at 916-319-2048 and politely demand a change in scheduling. Let's clog up his phones with requests for change in schedule.

Will lines 23 to 32 on page 4, concerning water for animals, affect the shipping of reptiles? Does this mean animals sent for overnight delivery will have to be provided with some sort of water source?

Perhaps, but how will they enforce on shipments leaving the state or arriving from elsewhere?

The interesting thing is AZ seems to follow CA when it comes to herp laws. Take a look at the current regs and see they are almost clones. Except for the hunting license thingy. I hope you aren;t next.

Last week we had two conference calls. One with a group of California pet industry folks like Petco, Petsmart, us, a large reptile wholesale, a rodent supplier, some bird folks, PIJAC and the California lobbyists.

The other was a "strategy" meeting. I listened in but mostly the lobbyists were laying out their plan with input and guidance from Marshall Meyers.

Mark Ridley-Thomas (MRT) has shown a willingness to allow input for some changes in the bill. The rationale is if one plans to regulate an industry then one should use well worded industry practices as your standard not those that make no sence and may be harmful for the animals themselves!

Hopefully MRT is a man of his word and will allow our input on this bill.

AB 2862 has passed in the Califrnia State Assembly. By a margin of ONE VOTE the bill moves on to the State Senate business and professions committee. This vote took place one day after P I A for animals, the bill's author Mark Ridley-Thomas (MRT), and representatioves for PIJAC sat down to "negotiate" the language of the bill. P I A rejected most of PIJAC's input. The next day MRT went onto the Assembly floor and told fellow assemblymembers that he is "negotiating with opposition" in an effort to make the bill passable. I won't call this a lie but certainly the truth was stretched to near it's breaking point.

The bill is now in the Senate business and professions committee. They are due to meet on this matter June 22.

We are making a "grass roots campaign" to get letters and folks to join our coalition against the bill. Click here to see the fact sheet for the bill.
