I live in So Cal. is it legal for me to sell a black and white Cal king on Kingsnake .com? I bought it from a expo and it is a adult het albino. I do sell other snakes here and I dont want to get in any trouble! thanks.

Same answer as I gave you on the rosy forum. You need a permit and the snake had to have been produced by a permit holder and you need to have the receipt from them.

what if they are wild caught? isnt the permit just a fishing licence?

Nope. No wc native herps can be sold under any circumstances. The permit is the California Native Reptile and Amphibian Propagation Permit and is completely different from a fishing license. Here is a link to the permit regs. Check out Sect 43.

This question is for Rick. I don't usually post on this forum. I usually post on the mexicana forum, but I like looking on here. You seem very knowledgeable about herp laws in Cali, and I always love learning about herp laws in other states. I live in Memphis, TN., and I was wondering if it might be illegal for me to sell a Cal king to someone in California if they don't already have a permit to have them, or is that just an interstate law. Thanks in advance for your reply.

Hi Ken. I don't know about the legality for you, but anyone in California purchasing a native species from an out of state seller who is not permited, is breaking the law. Whether they have a permit is really irrelevant as it is the seller that needs to be permited in order to sell cb Cal kings. For you, selling a Calif native to a resident in California is probably illegal (not sure about federal law), but I do not know who would enforce it. California LE can really only touch you if you bring the animal here yourself.
