Missouri Laws definition and who you ask

asking wildlife officials and reading wildlife laws are really hard to interpretate even among them and or vague : here is what it reads > venomous including native may be had with a class 2 wildlife breeders permit. This is to have, sell, given away, even transported. But several stories on Timbers ( crotalus horridus ) you can have them/you can't have them ! You can have up to 5 species non-venomous without ANY permit/license and everyone in your family can have the same. Species of non-venomous native can be legally had from outside Missouri with a class 1 wildlife breeders permit with what seems to be un-limited numbers and can be sold, bought, given away. It doesn't say a thing about receipts although I was asked to have them in case of. SO confusing !

Mike,

The Missouri Wildlife class II permits cover native only. Here is a brief rundown as we have gone over this before. These rules have been the same for a number of years now (at least 5).

1) Exotics over xx ft and exotic/native venomous: fill out paperwork stating what you have with the local sheriff.

2) Native MO hots. WC animals cannot originate from Missouri at all (unless you are an academic institution with permits). You have to have the class II wildlife permit to have CB native MO species even if bred out of state. There is no limit on the number you can have. You have to have all documentation of where the animals come from, and if you give/sell them away, who you gave/sold them to. If they are given in state, you must have that persons wildlife class II permit number.

The wording in the wildlife code can be confusing, but you have to read it very very carefully. Documentation is required for all native MO hot animals. If in doubt, CYA and take the conservative route.

respects, Michael < I read into your post that the class 11 permit is only for native species of venomous. it could be my upper 50ties age reading skills or eyesight, but if not here is the wording of code in the Field Guide to Reptiles and the Law :
Venomous reptiles, " INCLUDING " native species legally acquired from outside Missouri, may be imported, purchased, sold, or given away under the authorization of a class 11 Wildlife Breeders Permit.

So I read it as ALL venomous species ! I appoligise if this is what you did in fact post of All and I miss-read it. Also there is still the controversial subject of the collecting of native venomous of the state non-listed species. This is where you said to read the code carefully. One could decipher this as to being legal within the 5 total animals non-permit but registering with county law enforcement.

This wording is vague in the above > Venomous reptiles including native species legally from OUTSIDE Missouri....see my confusion and others > it doesn't remark on in state legal collecting. Therefore you are right by the wording of my opinion by not stating that the " outside " means no stipulation for legal collecting by native resident on native venomous but only legal by documented out of state.

I hope I didn't lose my train of thought on the above ! LOL ! Thanks..........

Mike,

I think you had two basic questions, and here I hope are the answers.

1) The Wildlife Class II permits are for native MO venomous species only. MDC does not regulate exotic snakes.

2) There is no legal collecting of hot snakes in the state of MO unless you are an academic institution with the proper permits. Period.

Under the Class II permit you are allowed to keep native MO hot snakes that were legally CB in MO, legally CB in another state, or legally WC in another state.

The five animals per person rule is for non-regulated species only. All native MO hot snakes are regulated. I know it is in that book somewhere it just takes some digging to find it/decipher it.

The section that gives the info is Chapter 9 section 3 CSR 10-9.110 1 and 2, and the section on Class 11 Wildlife, copperheads, cottonmouths, timber rattlesnakes, pygmy rattlesnakes, massassauga rattlesnakes , and mammals not revelant to reptiles is 3 CSR 10-9.240 of the Wildlife Code of Missouri.
