Posting pictures without consent

I was looking at the TOS for this site and saw:

Posting copyrighted documents or photographs here without the owner's permission is a violation of the Digital Millennium Copyright Act (DMCA). If you have an item that was used here without your permission, you must use our Interim Designation of Agent to Receive Notification of Claimed Infringement, following the policies and procedures as required by the DMCA. Claims of infringement that are not made as outlined in the policies and procedures of the DMCA cannot be acted upon and will be disregarded. More information on the DMCA and the procedures for notification of infringement may be found at http://lcWeb.loc.gov/copyright/.

Does this include grabbing pictures from other threads and re-posting them?

Or if I see something in the gallery, can I post that picture without permission?

Technically, that isn't true. Copyright law covers any original work, even if there is no copyright mark on it. however, who is going to sue over a snake picture, you certaily wouldn't make any money...lol

Fair Use - you can use the copyrighted works without permission under several for comment critisim or parody or as long as the due credit is given.

Hey, what do you know, my class WILL come in handy. This is such a screwy thing to try and figure out the exact laws and how they work. Different states have different laws and then the internet is a wole different story. I would say as long as you are giving credit, not making a profit, or using it in a negative way you should be OK. You could really have two usage situations that are almost the same and have two different outcomes in a court case. But like the other poster said, who is going to go to the trouble of suing someone over a snake picture?

What could be the damages?
As long as you are not saying that it is yours.
And if the photo has the owners name on it. What harm is there?

Which reminds me my new caramel albino I just purchased from the Snake Keeper.

The person who created the image owns that image. That image is their property. Would you want anyone to take, without asking, anything that is yours and use it? The question you should be asking is, if you use an image that is owned by someone else are you in any way infringing on their property?

I would not even consider using any image that someone else created with out asking them first and then only if they gave me permission would I use that image. I would of course give them copyright and credit for any images they allowed me to use.
This is the respectful and responsible way to do such things.

Please I said I have no problem with my pictures being used. I may add as long as my info is on my picture.
I can't even think how many of my pictures and yours are on someone's computer without us knowing.
I doubt if any are being used for profit.

Give you an example. I asked the Snake Keeper if I could use their photo of the animal I purchased. They said sure. They never had his logo nor name on the photo nor did they ask me to give him credit for the photo. I had it on my site and gave him full credit of the photo as a courtesy.
I had a person use my photo to resell my animal in the classifieds. They altered the photo. I told them nicely to remove my photo from his ad.
You may feel different. That is ok with me. Just my feelings.

Someone else made and use them without permission. I have had my photos used on this forum and on the classifieds without my permission. All of my images have my copyright on them but people re crop them and take off my copyright and then use them for banners, ads, and so forth. I have each time contacted the people myself before contacting KS or my attorney. If you would like to use any image that you have not created yourself then you need to have permission from the creator of that image in order to use it PERIOD.

And yes I've mentioned several times anyone that wishes not to be included in the WIR can let me know I have a running list of one - or it appears to be two now. LOL

Seems odd that one would post pictures for all to see and then not want them posted where most people look. But to each his own - I am happy to comply.

Idle curiosity. I just joined and wanted to know.

Since most of the pictures on this forum are hosted by this forum, I was curious if that made it okay. Seems like people are saying not without owner permission, or as long as the source of the picture is quoted. Is that correct?

There is a caveat to general copyright laws that allows you to reuse works without owner permission - generally if its not used commercially or for profit, if its used for educational or personal use if its used as commentary, critisim or parody is factual and/or is cited you may use it under the fair use caveat.
