is this is fox snake?

my boyfriend found this under his bag on his way back from the Mich. Upper Peninsula...we think it's a western fox snake? Any confirmation ?

I looked this up. Both kinds are supposedly in Michigan. I hope it's not an Eastern...the Eastern is threatened from what I've read. I'll have to drive back to the U.P. ASAP if that's the case. (I was going to keep this guy till my boyfriend and I drove back at the end of the summer) The reference I found says their habitats do not overlap, and that the western is typically found in the UP, and the eastern is found more in Southern Mich. Can anyone give me an answer for sure? They look very similar...

According to which part of Michigan he was in.. Most common fox snake there is the Eastern.

True, but he said he found it in the UP. Also, maybe I'm reading the info on that page wrong, but

Range and Status: The western fox snake is found in the Upper Peninsula, where it is often called a "pine snake." The eastern fox snake, of the Great Lakes marshes in the southeastern Lower Peninsula, is listed as a THREATENED species by the Michigan DNR and is protected by state law. Their numbers have been reduced by habitat destruction and, locally, by pet trade exploitation.

Sounds to me like only the Easterns are protected.

Yes, my boyfriend was up in the U.P. (this is the part of Michigan that borders Wisconsin)...that's where he found the snake.
