overweight??

I cannot say if this snake is to heavy, but in general snakes can surely get to heavy/fat and this will shorten their life.

i caught him/her about 2 years ago and have had it living alone...so i have ruled out being gravid. and i know that it wasnt pissed because it always looks that way. if it is overweight should i change its diet??

Well, garters have been known to store sperm for up to four years, so it's not impossible that it's gravid.

If you want an advise about changing the diet, you will first have to tell us what you feed this snake and how much and how often.

i feed him 2 large fuzzies 2 times a week...but what i think i am going to start doing is feed him 2 fuzzies once a week.

I think that is more than enough.
Four fuzzies per week is a bit too much, I think.

Also consider hibernating without food during the winter. Let'm use up some of those fat reserves like they were intended
