Naming question, any legal types??

OK, here it goes....I lived in England when I was about 7 years old, probably from like 5-11, give or take. I had Open Heart Surgury in London at what was at the time, the best childrens hospital in the world. All went fine! I was very lucky! My parents would come see me every day, several times a day, and bring me Rolos, that candy. Kind of gave me something to look foreward too each day, and took my mind off of the needles, testing, etc. Can I name the new Mojave cross morph the Rolo Ball? Legal issues? Trade Mark issues?

The babies are brown with caramel colored markings on their backs, and assuming they end up looking like the adult female, they are a caramel color as adults. Rolos, for those who do not know, are Chocolate and Caramel candies, think the name would be fitting. Milk chocolate (brown) and caramel (caramel), the color of the candy and the snakes. Anyone have any comments? I know most people would like to have a morph named only after we are sure it is not something already named, HOWEVER, I am getting tired of writing Mojave cross morph, when the original female is not a Mojave at all, and niether is the "morph." They got the name because the first offspring looked like Hypo Mojaves, but came from a Dom animal, not simple recessive. The "Morph", possible Rolo Ball, is on the right, center snake is what I believe is a Pastel Morph, and the snake on the far left is a normal male sibling. The two lone snakes are the adult female. She is more of a toffee, caramel color but in most pics, she comes out almost looking burgundy, but not burdundy in person. Any and all comments welcome!

What happened to Ember Ball? And I doubt the candy company will be coming after you for naming your snake the Rolo Ball.

Ember is a different project. I got lucky with two different females. First two are Rolo Ball female, last pic is Ember Ball female. Pic one she is in shed.

You could name it the Rollo Ball - Rollo means coil in Spanish I think.

In britain balls are commonly refered to as Royals. Would that make it the Royal rolo, or the rolo royal personally prefer Royal rolo.

why dont you breed your NEW MORPH,EMBER,ROLOS etc to normals to see exactly whats going on with them b4 mixing em with other morphs? I would think it would be beneficial to see exactly what their deal is b4 clouding the genes with other crosses.

The Ember was bred to a Ghost male last year, and Pastel male this year. The Rolo female was bred by a Pastel this year because I knew a Mojave cross (Mojave Rolo) was being bred to normal females, which showed us what we needed to know. Ember and Rolo, two different projects. We know what a Rolo looks like, the morph, uncombined with anything else. We got the same looking morph in several different clutches. I do not understand what breeding a normal male would provide us, that we do not already know. The next step is proving out a Super, which will happen next year. The adult female Rolo is pounding large rats, and is huge already. Normal on top, Pastel Rolo in the middle, Rolo on the far right and far left...

First let me say I am not a lawyer...but I do deal with naming rights in my job all the time. What I can tell you is registered trademarks are associated to the category of the product. So a candy company can trademark Rollo and someone else in a completely different category (ie. snakes) can trademark the same name as long as they don't compete and you don't attempt to leverage the firsts trademark (by this I mean you cannot refer to, advertise, claim or associate in any way to the candy company or try to profit from the success of the candy company)

That is kind of what I thought. I tooks several business law classes in college, and my thoughts were, as long as they are not two companies in the same type of market, competing, that it should be fine. I emailed Hershey just for the heck of it.
