I know BT and WT are illegal to have in New York, but does that include the Cape Banded WT? I thought it was a size issue and I've read Cape Banded WT get around 4 feet. Is this true?

I don't know for sure if the locale of white throat you mention actually stays that small, but the New York laws go by species, not by size. Therefore, if it's classified as an V. albigularis, which both white throats and black throats are, it is banned. I assume that this Cape Banded White Throat you mention is a specific locale of V. albigularis, and that would mean it is banned.
