Provincial legislation affects species native to Ontario only. Most are protected and cannot be captured, kept, bred, bought or sold without a licence issued by the Ministry of Natural Resources. (By “capture” I mean catch and take home, not catch, photograph and release.) The relevant law is the Fish and Wildlife Conservation Act, 1997 and its regulations.

Those species that are not protected under the Act may be kept, bred and bought or sold legally, so long as they were legally acquired. But they cannot be taken from the wild without a small-game hunting licence.

There are exceptions to these rules, but they probably don’t apply to you. Contact the MNR for more information.

In general, you really shouldn’t take anything home from the wild, and yes, you do need a licence even for captive-bred specimens of protected species — that albino Black Rat Snake included. Them’s the rules.

Snakes

Protected: Blue Racers, Eastern Fox Snakes, Black Rat Snakes, Eastern Hognose Snakes, Eastern Milk Snakes, Lake Erie Water Snakes, Northern Water Snakes, Smooth Green Snakes, Queen Snakes, Butler’s Garter Snakes, Eastern Massasaugas.

Not protected: Northern Ring-necked Snakes, Brown Snakes, Northern Red-bellied Snakes, Northern Ribbon Snakes and Common Garter Snakes.

Lizards

Protected: Five-lined Skinks.

Turtles

Protected: Common Snapping Turtles, Painted Turtles, Spotted Turtles, Wood Turtles, Blanding’s Turtles, Common Map Turtles, Common Musk Turtles.

Frogs and Toads

Protected: Blanchard’s Cricket Frogs, Bullfrogs, Fowler’s Toads and Gray Treefrogs.

Not protected: American Toads, Green Frogs, Leopard Frogs, Mink Frogs, Pickerel Frogs, Wood Frogs, Spring Peepers, Chorus Frogs.

Salamanders

Protected: Eastern Tiger Salamanders, Spotted Salamanders, Smallmouth Salamanders, Jefferson Salamanders, Blue-spotted Salamanders, Red-backed Salamanders, Four-toed Salamanders, Two-lined Salamanders, Northern Dusky Salamanders.

Not protected: Eastern Newts and Common Mudpuppies.
