Response to "Free the Dubuqe 3!"

Dear reptile lovers,

We want to thank each and every one of you for all of your support and your emails and letters to our mayor. That support means a lot to us. We are responsible pet owners and our animals have always come first. For those of you who may not have heard, on January 3, 2007, our home in Dubuque, Iowa was invaded by four police officers, two animal control officials, a representative from the Dubuque River Museum, a park ranger, two housing officials, and two representatives from the health department. This was in response to someone lying to city officials and claiming that we had boa constrictors, pythons, and venomous snakes. We have a collection of more than three hundred snakes, all of which are well cared for. The officials confiscated three baby sand boas, two milk snakes (caught in Wisconsin, one by a three-year old girl), and one indigo, purchased from a reputable breeder, that we’re in the process of obtaining the permit for. Our local newspaper, the Telegraph Herald, published an article full of misinformation. Among the most glaring errors were their inclusion of a photo of a Columbian boa constrictor (which we do not own) and a false claim that officials found boa constrictors in our home. Our privacy has been shattered and our home invaded because an individual that city officials refuse to identify decided to falsely accuse us. Since this occurred, we have received a lot of media attention. Many of you have been very supportive, and in response, we just felt that we owed you a bit more of an explanation of what really happened. Thanks again for your letters and emails. We really appreciate it.

My heart goes out to you. We really are moving towards martial law whena person who makes unfounded claims and remains anonymous can cause such upheaval in an innocent family.
You should definitely be filing a civil suit, and subpoena that person's identity, and statements. There's no reason you can't. Jerks like that need to be seriously censured.
My heart goes out to you!

I have to agree. This is a serious invasion of your privacy, based on unfounded and undocumented information. To invade/raid your house they had to have a search warrant I am guessing, and that warrant would be based on columbian boas, poisonous snakes and pythons, so if you did not have any of these animals, I think you get a lawyer asap, get your animals back and file a harrassment suit or other civil suit, but I would not let it slide. They came after you in a very aggressive manner, and I suggest you do the same. Just my thoughts, Brad Lichtenhan...........if we can send more emails or do more, let the community know.

what bothered me the most about your case is that they made it sound as if you were some crazy couple who just took a liking to living with snakes, such as people who collect cats or dogs. They made it sound as if you had mental issues which is what stems most people to collect cats they way they do. It made me so mad, I recall going to work that day and some of my co-workers were talking about you. I told them that if they truly looked at the footage of those animals they'd see they were taken care of, their enclosures were clean, the ones they showed on television had clean substrate and I didn't notice any with any clear signs of abuse, but the news and papers made it sound as if you were just horrible because the hatchlings were in deli cups. I had a great time explaining to about 30 different people why they are kept in those containers and how it benefits the animal sense of security, etc. I fully support the idea of a civil suit in the least. It seems they had a boat load of head bees at your door, but not enough workers bees doing the research on your pet of choice. At most when they received the complaint, they should have sent one maybe two people to knock on your door to ask questions, not thirty freakin people and a news crew for pete's sake.

How many people do you see on the news that have ten dogs? How many times do you see people on the news when their dog has puppies? It's just rediculous, sorry if I don't shut up now, I'll rant all night.

I'm so sorry you had to go through this pathetic ordeal. Hopefully you can put it behind you and gain a little peace of mind later on. I'm sorry for the loss of your other snakes, but at least you may get your indigo back with proper permits.

Good luck hon,
Izora

I am not a snake owner, but I was compelled to write an e-mail to the mayor in any event. I asked for the return of your snakes, and pointed out that when they write these "laws", they need to make sure they are correctly identifying potentially dangerous animals, and not just grouping all snakes together as one. Of course I received no response.
I also mentioned that statistically, injuries/deaths to humans from animals are mostly caused by dogs, but I don't see communities banning dogs.
I feel terrible about your situation, and hope you will eventually find out the person who reported you, and get your snakes back. Take care.

You indicated you were "In the process of obtaining a permit for an indigo". I take that means you already had the specimen?
Having worked with Drymarchon couperi, along with every other available Drymarchon spp., for over 30 years, I am not aware of a single instance where it is legal to first obtain a specimen and then obtain the permit, whether the permit indicated is state endangered species permit or the Federal interstate commerce permit.
While I am shocked over the events which have transpired and the confiscation of your animals, it doesn't sound as if you were following the "letter of the law", at least in regards to your indigo.
However, I do wish you the best of luck and I hope you are able to turn the tables and regain all the specimens that were confiscated.

Best of luck to you,

My family is from dubuque and I was suprised the first time I revisited a few years ago and went to the petco bordering the town. I couldnt believe ball pythons and emperor scorpions etc. were not allowed "across the street" in Dubuque. I guess they have since lightened up and began to allow some exotics. The town has definitely gone to hell. I was planning on retiring to their in the future and returning to "my roots" but not if this is the direction the town is heading now. Luckily the area I am looking at now is actually Bernard. good luck to you, keep us posted.... Jon Runde

I fear the mayor just hits the delete button on all these messages he is getting now, but he has to hit the delete button enough times to realize that he and this ignorant policy is wrong.

While I definately feel for you, there probably isn't much you can do to get your snakes back. If you tried to stage a big media campaign, many people are going to see that you illegally kept indigo snakes and are going to think of you as a law breaker. When that happens, you lose credibility. It doesn't make it morally right or wrong, because even I don't agree with all of the laws, but some people are die-hard on laws.

I'm not sure what the laws are in your state, but I know of at least one raid in Florida where a man had an indigo snake illegally, and the wildlife commision took every one of his snakes and he was fined several thousand dollars. He lost around 300 snakes and eventually just had to start all over again.

It's probably hard to hear, but the best thing you could do is take it as a hard lesson learned and start over again.
