is it a garter? hope it's not venomous...gonna release it tomorrow far away from the road that i found it on..

That is a brown snake(Storeria dekayi). The subspecies would depend upon where you found it. They range from south Florida up the entire eastern seaboard.

Have to disagree - that's definitely a garter snake. If you can say what part of the country you found it in, there's a better chance of determining the particular species/subspecies. Looks like a spotted phase of the Eastern Garter snake, tho.

The specimen is one of the many variations of the eastern garter snake (Thamnophis sirtalis sirtalis). I've found them in many shades of green, brown, yellow, and reddish. With stripes renging from yellow, to white, to blue.

Sorry, guys. I looked at the thing for a second & didn't pay enough attention. That is definitely a T. sirtalis. I'll try to pay closer attntion & not be in such a hurry in the future.
