What would the cost be?

kcaj Apr 12, 2007 09:44 AM

If the below mentioned bill were to become law, What would be the consequences? What is the cost of a ticket? Are there forfiture laws in Texas? If I have heard correctly, it is legal to possess reptiles and amphibians with a valid license, Right!
So a person would have to be observed taking an animal from a roadway to be breaking the law. It has already been mentioned that spotlighting is legal as long as the light isn't shined across or along the roadway. I believe that the only real enforcement would just be harassment to discourge the activity. And one final note, if you are given a citation for any reason always contest, contest, contest. If it is a misdemeanor ticket ask for a jury trial, it really pisses them off. Especially if the cost of the ticket is small. Jack

You know many people because of jobs or other commitments cannot put the time in to run through all the appeals. Especially our guest from out of state, and TP&W knows and has exploited this in the past.... I suspect that they will catch the worst of it. But if this law is passed without modification none of us will have any solid ground to stand on anyway.

That's right we would have no leg to stand on in court. This law would supersceed the old law.

well, if you fought it on constitutioal grounds (you'd lose at lower levels) you could eventually/potentially win on the ground that it unfairly singles out herpers while simueltaneously exempting falconers.

... I would rather abort this think than try to kill it later.

Yes and on that note these reps and TPWD need to understand that we will never go away and that we will make ourselves a perpetual thorn in their sides until we are free to enjoy our hobby.
