How many of you have a Web site?

I'm going to post a summary of Legislative Abuse by Harvey Hilderbran on the FRONT PAGE of every Web site I own and every other avenue that I can secure.

I will then ask that every single person who reads it pass it on the every single person in their address book residing in Texas, especially those that reside in District 53.

The primary goal is to get Harvey Hilderbran Voted out of office in the next election.

We shall also make campaign contributions to whomever runs against Harvey in the election, and campaign for that opponent.

This is critical, this is not BS, this is WAR, this is how we control those that make our laws.

Here is the text that I will be displaying:

LEGISLATIVE ABUSE BY REPRESENTATIVE HARVEY HILDERBRAN DISTRICT 53

HB 2414 was introduced in the House with language that would have banned collection of reptiles and amphibians on public roads and right of ways in Texas. Numerous objections and concerns were raised about this ban. As a result, the House amended HB 2414 to remove this ban. The amended version of HB 2414 was then passed unanimously by the House. Due to time constraints at the end of the session, HB 2414 then died in the Senate without a vote.

HB 12 passed the House and Senate but had to go to a conference committee to resolve differences between the House and Senate version. Neither version had any of the HB 2414 text.

According to the Guide to Texas Legilative Information:
>>A conference committee's charge is limited to reconciling
>>differences between the two chambers, and the committee,
>>unless so directed, may not alter, amend, or omit text that
>>is not in disagreement. Nor may the committee add text on any
>>matter that is not in disagreement or that is not included in
>>either version of the bill in question.

Hilderbran got around this limitation by authoring, introducing and passing HR 2912 ( History) ( Text) in the House and getting Senator Estes to author, introduce, and pass SR 1195 ( History)(Text not yet published, presumably the same as HR 2912) in the Senate.

HR 2912 and SR 1195 gave the Conference Committee on HB 12 permission to add the pre-amendment version of HB 2414 (despite the fact that this text was defeated via amendment in the House and was never voted on in the Senate) by stating the following:
>>(9) House Rule 13, Section 9, is suspended to permit the
>>committee to amend Subchapter A, Chapter 62, Parks and Wildlife
>>Code, by adding Section 62.0031 to read as follows:
>>Sec. 62.0031. HUNTING FROM PUBLIC ROAD OR RIGHT-OF-WAY
>>PROHIBITED. (a) Except as provided by Subsection (b), a person may
>>not hunt a wild animal or bird when the person is on a public road or
>>right-of-way.
>>(b) This section does not apply to the trapping of a raptor
>>for educational or sporting purposes as provided by Chapter 49.
>>Explanation: The change is necessary to prohibit certain
>>persons from hunting a wild animal or bird when the person is on a
>>public road or right-of-way.[/list]

The Conference Committee on HB 12, chaired by Hilderbran and Estes then drafted the Conference Committee Report that drastically changed HB 12. The revised bill was then pushed through the House and Senate in the end of session rush.

The end result is that a ban on roadway herping that was defeated in the House and killed in the Senate (by committee delays) was snuck into another bill and passed into law (assuming signature by the Governor). These actions by Hilderbran and Estes thwarted the intent the Texas House, ignored the inaction of the Senate, and blindsided thousands of Texas hobbyist and sportsmen.

I'll be creating the page immediately, if anyone would like me to send the simple HTML file when I'm done please contact me at joe(dot)forks(at)gmail(dot)com

I am at a loss, I hope that this is worked out and this bill fails But Texas herpers spokes person Randal Berry has said that this was a dead issue many times before
He said it failed in commity
He said it failed to make the senate floor
and recently said that he personally spoke to A senator (and had it recorded) That the bill was dead.

Now I am trying to understand why he would continue to post here why it was dead and he even took credit for killing it. If this bill did pass and is going to the Govenor to be signned, I want to know why Mr. Berry told us that it was dead? Maybe Texas herpers need a new spokesperson, one that will tell the people the facts not what we want to hear. If (as it did) pass commity then that is what needed to be posted not that it failed (which was not the truth.

The fact that the Bills passed so far effects the people in Texas and thier livelyhoods and thier families but Mr. Berry lives in Arkansas where he is a bird keeper at a small zoo, true he has a small show that he will have to change (restructure) but Not stop but the bill will stop people from making a living.

I am sure that there are many people in Florida and other states that will be happy to help, PLease post anything that we can do.

the blame goes squarely on Representative Harvey Hilderbran's shoulders for orchestrating the legislative abuse I outlined above.

We ALL thought this was a dead issue for this session, Harvey Hilderbran back-doored us

he had us all put our elbows on the table for this one.

Joe, can I send a copy of that to Clay Robison, a reporter here at the Houston Chronicle? I've already written him a letter, but what you've outlined is much clearer and more concise.

Troy and Eby worked out that text, so give them the credit for that, but at this point no one is worried about who put it together, we are all worried about sending the message.

I'm working on the HTML files right now.

Okay, I will go ahead and send it then. There is also an investigative team at the NBC affiliate that I have been in contact with. I will send it on to them. This may be a little more interesting to them then the original issue, though they did have some questions about it as well. Thanks. And thanks to Troy and Eby.

Joe Forks Jun 01, 2007 09:23 AM

I'm cleaning it up a bit and then I'll post it on my site, and then you can send it.

Eby Jun 01, 2007 09:45 AM

As Joe said, feel free to copy, paste, post, distribute, enhance, revise, or in any other way use ANYTHING that I have posted ANYWHERE in opposition to this crap legislation.

I don't give a rat's a$$ about credit. I just want victory and revenge.

One suggestion however: Making your own revisions and adding your own personal points, will typically add impact. A hundred different letters have more impact than 100 copies of the same letter.

I don't have a website, but I think it's a great idea to support Hildebrans next opponent any way we can. Count me in.

I posted a link to this on the main page of my website. I also have two banners on my forums that link to this information as well. I will continue to circulate this information and write and call as many people as I can. BTW, I have some pretty good radio contacts here in Austin and can probably set something up in the near future. I know a station that could give me a thirty minute interview. Please contact me via email or for more information.

I'll see if I can Troy or Eby to coordinate with you about the interview. I'm afraid I may come off a bit radical
