Please tell me where my logic is flawed. Let’s say I am deer hunting and have a camera with me. I take a photo of a herd of deer or any animal that is not legal to take. I would not get ticketed for hunting illegally. If I am pulled off of a road and photograph a snake without touching it and have collection gear on me I could be ticked for hunting? This makes no sense. Both of these scenarios would be the same but the outcome is different. The real question would be if a judge would see it my way. What if I photo a person while legally carrying a concealed hand gun. Would I be arrested for attempted murder? That might be a stretch but it would be the same logic.
