Texas Lawsuit

jeffb Jul 10, 2007 11:50 PM

I have discussed this with the directors of our corporation and we are interested in funding a lawsuit that seeks to obtain an injunction to halt enforcement, and to overturn the reptile provisions of HB 12, even if it means overturning all of HB 12
or halting all the provisions of HB 12 from taking effect. We are willing to drag this through the courts for years to seek a positive result. If you are a lawyer licensed to practice in the state of Texas, and are familiar with the issues involved, and have some ideas on how to meet these ends, please contact me directly. Yes we know how much these things cost.

Were it not for l. alterna, the field herper culture, and The Alterna Page, kingsnake.com would not exist. The least we can do is pay it forward, or backward in this case.

I like the idea... But details of any strategy should not be posted here... Leave those up to attorney client privileges.

We need to treat it like a poker hand and wait until it is time to put cards on the table.

Fantastic idea.

I can think of no better manner to fight this thing than the way that Jeff has outlined.

Sweet! Thanks for stepping up to the plate for all of us.

Everything about the 1309 and 2414 riders on HB12 just reaks inside dealing, dirty politics, hidden agendas, and legislative abuse.

We tried to play nice, but they just keep ignoring us. It's time to kick some sand.

While I am not a memner as yet of your organization, Joe and Lance know of me and my concerns, while I am no layer I can still help as well as all of us can, and thats to give to the cause, if you put together a viable group with lawyers I would be willing to give what I can to help which while it isn't great if all the herpers can or would get behind you all we might see this thing turned over.......

Also I noticed your list idi not include the Devine Newspaper and Lytle Paper as well? I can get this infor for you if you would like.

Jeff,
To help defray some of the costs for KS, maybe a location (paypal link, etc) would be helpful so that those of us that wish to contribute can do so. I'm sure there will be many. Myself included.

I know that until you have a lawyer draw it up there is no firm answer... But I wanted to find out if this was to be a class action type suite that we can all sign up for? I know we would not expect a $ettlement, but instead a correction of things taken without justification or proper process as well as accountability for those that orchestrated any underhanded deal.

I would be happy to lend my name and support for any legal action to drag things into the light of day.

Jeff,

It is a wonderful thing you are doing to repeal unjustified herp laws and regs. Please let me know how I can help. I don't have any funding I can donate at the moment but I can donate my time and expertise. And everyone thought people who sell herps made a fortune......WRONG!

We should also get this ignorant and horribly misguided "White List" repealed while we are at it. Any law or reg that bans captive propagation is bad for the herps. Further, you don't ban commerce in animals that are common or have little demand. We need to restore a persons right to breed and commerce in those species not on the "White List".

Please let me know how I can help.

Thanks Jeff. I think we all need to pitch into a fund and help support this as was mentioned in a post above. Clark

As soon as this is filed in a court of public record he has already lost, at least in the area of general public support. Not many people will back a candidate that has in his recent past a legal action calling into question certain legislative tactics.
