According to Conant/Collins, the lateral stripe on a Texas Garter involves row 3 and adjacent parts of rows 2 and 4 on the forward third of the body. Otherwise, it indeed is on 2 and 3. This presents a bit of a mystery in the case of your pic, because it looks to me like the stripe is confined to rows 2 and 3 in the neck area. The orange dorsal stripe says Texas Garter to me, but I've seen Red-sided Garters that also have a distinctly orange dorsal stripe (and very little red on the dorsal scales).
As far as other color/pattern variations, I assume that Texas Garters are subject to similar amounts of variation as other Thamnophis sirtalis subspecies. But I'll defer to others with more experience with that particular subspecies for more info.
