A question about privately owned land...

jcraft75 Aug 06, 2007 02:00 PM

I am originally from NJ, and the laws there state that land that is not fenced must be posted every 100' or so with no trespassing/no hunting signs, or the land is considered open to the public.

Is TX law similar? I was wondering if unfenced/unposted areas are free to explore?

You might be able to "get away" without the citation or arrest, but a fence, even a broken one is pretty cut and dried hear. If they have a sign or purple markers then can get in real trouble.

Best advice is not to get on any private property without permission. That is what any herper I know would do, and that is why we were on the Right of Way in TX.

Clearly I was asking about unfenced property, is it legal to explore/collect if there are no postings stating otherwise?

Texas has a lot anti-trespassing stuff in play.. and very little public land, none of which you can herp on by the way.

Texas has sunk a long way if you ask me.

Not that I am aware of.

If anyone knows of such, please post the info.

There is National Forest in East Texas. That should be open to collecting.

As far as I know, Texas is the same, if it is unposted(no fence, or markers) then you can legally trespass. If you are told to get off the property and do not, then you are illegally trespassing. I would look it up or ask someone in LE to make sure.
