keeping poisonous snakes, California

rbichler Aug 18, 2007 10:45 PM

I ran across a local add on Baby Albino Western Diamond Back Rattlesnakes for sale. I thought it was against the law in the state of California to even house poisonous snakes. Can anyone comfirm my thoughts.
Thanks;

I could definitely be wrong but I don't think there is any law agents it but I do believe there are laws on how they are housed. Also keep in mind agencies such as CPS may have a big problem with keeping them in the same house as children

Its best to ck with the city as the state may not but the city may have a law in place, it also may not be a good ideal to let your neighbors know you keep any reptiles. CPS can be a pain to deal with too.

Thanks everyone for your replies,I believe all three of you are right, and if not, should be.

The Fish & Game Code prohibits the keeping of non-native (to California) venomous reptiles without a special permit. Western Diamondbacks are native to California, and thus are legal. However, there are any number of cities and towns that further restrict keeping of ANY venomous reptiles within their borders.

Cheers,

Bob

Dont they also require enclosures with locks and other security measures? This in my opinion should be common sense but I am pretty sure I remember reading that.

Yes...sort of. My reading of the DFG regs, below,

suggests that all of those requirements apply ONLY to those with permits to possess "restricted" species (in this sense, non-native venomous reptiles). For example, if you conducted educational presentations and obtained a permit to possess a Beaded Lizard, you are required to meet certain caging and security requirements, as well as having a written envenomation protocol on hand, and you are subject to periodic inspection by DFG wardens.

Cheeers,

Bob
