Texas Laws: What Exactly Passed?

mfoux Sep 03, 2007 11:35 AM

I'm new to this area of the forums and just bought a home in Texas (I currently live in Louisiana). I maintain a small collection of snakes that will be ready to breed in 2008 and 2009. Some of my snakes are also pets and I have no intention of breeding those. There are so many posts that I'm confused about the entire nature of the new law(s). Can anyone help me?
My questions are:
1. Are my honduran and pueblan milks now illegal? Does the law cover all constrictors as it was originally written.
2. Is my greybanded king (a pet, captive bred in Florida) illegal?
3. My two pythons, a ball and a carpet?
4. Did the law concerning the large constrictors pass? I intended to get a Bob Clark purple albino retic to keep as a pet (not to breed). Is this now a big no no? Is there a permit associated with this?
5. What do the new laws mean for my collection? I understand that there is a dealer's permit of some sort ($60?). Is there some sort of possession permit that I need to keep my pets?
6. Has the state posted the new regulations anywhere? What is actually prohibited and regulated by the new law(s)?
7. Do I need to worry about the legality of my sulcata?

Any help understanding this new situation would be greatly appreciated.

1. Are my honduran and pueblan milks now illegal? Does the law cover all constrictors as it was originally written.
no, it was changed to include only the big 5

2. Is my greybanded king (a pet, captive bred in Florida) illegal? No, but they may require a permit unless you can provide a receipt.

3. My two pythons, a ball and a carpet?
Though a permit does not exist for these, Tpwd has to follow legislation and develop a permit for the largest constrictors which will not include ball pythons.

4. Did the law concerning the large constrictors pass? I intended to get a Bob Clark purple albino retic to keep as a pet (not to breed). Is this now a big no no? Is there a permit associated with this?
It's not a no-no, It will have to be permitted as it's on the list for large constrictors.

5. What do the new laws mean for my collection? I understand that there is a dealer's permit of some sort ($60?). Is there some sort of possession permit that I need to keep my pets?
The dealers permit is only for animals of texas origin or those found in texas including those with that live in other states as well.

6. Has the state posted the new regulations anywhere? What is actually prohibited and regulated by the new law(s)?
Not on their govt website. Some forums may have copied and pasted hard copies.
7. Do I need to worry about the legality of my sulcata?
Not currently.

hope this helps

That may well be the only chance of survival.

It is my understanding that HB 1309 applies to certain nstrictors and venemous (non native) only. Nothing is banned by the law. Permits will be required for the listed species.
Also., the "white list" conatins native species that may be collected it doesn't affect non-native. Go to HCU.org for details.
