This question has also been sent to the federal permit office for clarification.

My brother (state of NC) has been wanting to get into indigos for some time now. I thought for Christmas, I could locate breeder and buy my brother a pair as a gift. I looked for over a month to try and find a breeder in NC, but couldn't find any. I was finally able to find an indigo breeder in VA that had red throats.

Now with Christmas a few weeks away, does anyone know whether this constitues a 'legal gift' by the federal permit definition.

I buy the pair now (in VA). btw, I have the state permit already. I keep the pair until Christmas. Then on Christmas, I give the pair to my brother as a gift. Since it's a gift, my brother won't need a permit to transport the pair back to NC, correct?

He will need a permit to transprt across state lines, whether it is a gift or not. If he obtained the snakes in NC he would not need the permit.

NO. No. No. Here's the deal. And this is correct, but if you don't believe me, call the Feds and ask them, and they will surely say I'm right. The guy to talk to is at 404-679-7313. He's the guy who handles the Federal Interstate Commerce Permits. And buy the way,...IT"S NOT A PERMIT TO TRANSPORT. It's a permit to do commerce with a listed species accross state lines. But,....If YOU PURCHASE the snakes from a breeder who resides in the SAME STATE as you, then you do NOT NEED a Federal Interstate Commerce Permit. If you purchase them from someone who resides in a DIFFERENT STATE than you, then you WILL NEED to get the Federal Interstate Commerce Permit. When you GIVE an indigo or indigos as a "bonifide gift" to someone, regardless of where they live, there is no Federal Interstate Commerce Permit for that. It's only required if you {trade for, or purchase} an indigo accross state lines. Trades and purchases constitute "Commerce", and accross state lines constitutes "Interstate". If you have any further questions I would either call the Federal Wildlife Office in Atlanta, which I showed above, or, go to www.indigosforever.org and get the facts. That has to be the best explanation of the "What's the deal with the permit?" question I've seen yet.

Why, even I understood it!

One of the posters above beat me to it, but Rick Sladick is an indigo breeder from NC. I've purchased several animals from him in the past(not indigos) and he is a stand up guy. And I think he has one indigo left for the season. Good luck.
