River Rd tonight

was upper 70's to mid 80's at midnight and dry as a popcorn fart. Luna Vista was in the mid 70's at dusk but dropped quick. We saw 1 DOR suboc in Mud Flats and what I think was a Ringneck that was gone when I got back to where it was. If it doesn't start raining soon, dust is all I expect see.

We hit RR 2 nights 2 weeks ago. We found 6 dor subocs and 1 alive, 2 dor patchnose, 2 aol gophers, 2 dor that I could not id, and many aor atrox. On the way down to study bute we found 2 dor pink coachwhips. We found no tarantulas or scorpions which is what I was looking for. We were stopped a total of 9 times by border patrol and told them what we were doing. Like previous years they just looked and thought we were nutz. We were passed twice by F&G. we waived and they waived back. They never stopped. We had decided in advance we would test the waters and tell the truth as to what we were doing. Where we were passed we had pulled completely off the shoulder. It was daytime and we had hooks and bags in hand when they passed. I will be back in a week and am looking forward to F&G stopping and talking about it. If they ticket me oh well I’ll pay it on my way back to the hotel after sunup, not going to stop me I’ll just start hiding it a little better. I have heard rumors as to what they are going to do but I want to know

Don't be in too big of a rush to pay any tickets related to road herping. Unless they see you handling or bagging a herp, they have a weak case that deserves to be challenged. Heck, even if they witness an obvious violation, it could still be a chance to challenge the law itself. There's been lots of talk in the past about HCU and various individuals pitching in to cover legal costs. I assume those offers still stand (unless the violation is particularly egregious and goes way beyond simply collecting a couple of imperiled herps).

I AM NOT CONDONING COLLECTING HERPS IN VIOLATION OF THIS LAW. I'm simply saying that I find it onerous and misguided. If we have a decent chance to challenge it in court, we should.

I stay in southern Brewster and Presidio Co because my main objective is Coleonyx reticulatus (which I have a permit for) and I have study sites here that where part of my project from the 80's. It is interesting to compare data from 1987 to 07 and 88 to 08.
As for being stopped, I am required to contact the warden before I work in the county. I am the only one here for now and have not been stopped by anyone. I was told that DPS will station an officer here this year, so much for the lawless state of Terlingua.
