wife found her 1st grey band 5/11/08

Will it happened. she found it at 1:57 am on 9 mile cut. She saw it while shining the cut from the van. She yelled snake and before I could stop the van she was screaming grey band. The seat belt would not let her out and I thought she was going to take seat and all out the side door. Here’s the pic

Mr. Hollister has been cleared. I have a couple more suspects though and since you have viewed this thread I will let you know that the animal in question was not collected… Per what I understand the law to be we in no way impeded its movement and only photographed it in its natural environment. Wife still ticked off and were still laughing about it(when she’s not looking).

You dont have to be worried about me. Whether you picked up the plastic snake or not. Remember, there is also no law against picking up LITTER. Remember, KEEP TEXAS HIGHWAYS CLEAN.

I am all for picking up critters in reasonable numbers. Being safe, having fun, etc...

I agree with Steve it will be hard to hold up in court anybody caught with fake snakes as bait because you can observe and photo live animals and if it is not an animal but a fake then you are doing no more than picking up litter on the side of the road. It is also not possible to prove "intent" as you can still hunt the roads for inverts and raptors, plus it is not illegal to have herp type collecting gear in hand.

Now it may be a different song and dance if you see a dead snake on the cut (cryo-herp). I am not sure of any provision in the new law allowing for any recovery of DORs from the ROW???

Bottom line is that neither side is going to make this easy for the other here... We need to get the law fixed, this is just ridiculous.

Check the FOI documents again, we have it in Sinclair's words that DOR's are OK too.
