Connecticut Animal Ban Passed . . .

Well, after many months of waiting to be scheduled, and widespread reports that the Connecticut animal ban would not reach the House or Senate floors during the current session, guess what?

In a last-minute rush, on June 3, this bill passed both House and Senate - in a greatly reduced format. In no small part, this was due to Andrew Wyatt and USArk, who reminded the committee sponsoring the bill that:

A) The bill would ban an awful lot of animals (including, but not limited to reptiles) which have never injured anyone who wasn't directly working with them, or who wasn't exposed by someone working with them, while leaving a great many animals (including some with powerful lobbies) on and in the streets, forests and farms of Connecticut which _had_ caused such injuries, and that;

B) The Reptile Nation can raise one heck of a ruckus, and would be perfectly happy to make the lives of legislators and their assistants "interesting" with a major grassroots campaign.

Andrew had been in communication with the sponsoring committee, and like many of us, had been waiting to hear when the bill would be scheduled for hearing by the full house. He was alerted on June 4th that the bill would be coming up for a hearing - on the 3rd. On that date, the bill passed both House and Senate, but now only bans wild felines, wild canines, bears of all sorts and primates in the family Hominidae (great apes).

This provision:

"[No] (a) Except as provided in subsection (c) of this section, no person shall import or introduce into the state, or possess or liberate therein, any live fish, wild bird, wild mammal, reptile, amphibian or invertebrate unless such person has obtained a permit therefor from the commissioner. [, provided nothing in this section shall be construed to require such permit for any primate species that weighs not more than fifty pounds at maturity that was imported or possessed in the state prior to October 1, 2003. ] Such permit may be issued at the discretion of the commissioner under such regulations as the commissioner may prescribe."

remains in the bill, and gives me some cause for concern.

The bill was heavily pushed by Born Free U.S.A. and the Animal Protection Institute.

Big thanks to Andrew for helping the residents of Connecticut - like myself - to hold onto the right to keep big constrictors, crocodilians, spiders & scorpions, dart frogs and hots - at least so far as those rights already existed. I may never decide to keep any of those animals, but it's nice to know I can! (And I do love the dart frogs . . .)

Just another example... if we don't get our collective heads TOGETHER to fight the AR agenda, our hobby is dead, PERIOD.
The AR folks just shot us in the foot in TX but we are by no means done fighting.
The hard reality folks is this, AR is pop culture right now. Everyone and their mom with money feels good about themselves by donating to AR groups. So they have LOTS of money for lobbyists, campaign donations, etc. If we as a group do not follow suit and take this as seriously as they do, all is lost. They are the squeaky wheel and they are getting the grease. You need to ask yourselves, "What am I willing to so?" and "How important is this really to me?” If you don't answer Anything Necessary and Extremely Important respectively then you might as well give in.

Exactly what has happened with road cruising in Texas? With the effort put forth to exclude reptiles, I haven't seen too much on the forum. Was the wording included with the other bill or not?

As far as I know it is still illegal to collect reptiles from the roads and right of ways of Texas. The bill to overturn the road ban and allow road collecting did not make it to fruition.

Unless I've lost my understanding of English, it appears that this bans reptiles and amphibians entirely.

So you can't import into CT, or possess within the state of CT, ANY reptile, amphinian, etc. (it specifies WILD bird and WILD mammal, but makes no other distinction regarding WILD or otherwise for herps and inverts) unless you are granted a permit at the sole discretion of the commissioner. What are the chances that the commissioner will issue such a permit? Slim to none, I would imagine.

What does subsection (c) say? Unless it specifically contradicts the quoted portion of the new law, it sounds like you fine folks in CT just got screwed by the AR lobby and your elected officials.

The way I read it, now you can't bring them in, nor keep the ones you already have, unless the commissioner specifically grants you a permit.

Agreed. That similar wording has been in CT regs for years (and I've been trying to tell you guys that), and I've had CT residents ask permission to bring in adopted TURTLES, some of which were so screwed up there's no way they could survive outside for a month on their own, let alone threaten a person or native wildlife. All were DENIED by the state - not even given a chance to fill out a form.

Preexisting law remains in effect. CT already had some pretty restrictive laws. HR6552 has dropped all reference to reptiles on its banned list. Any laws that were already in effect must be observed. The only change for reptiles is a provision relating to disposition of animals (including reptiles) that are already being held ILLEGALLY... under current law. HR6552 does not add any new restrictions to reptiles that are being held LEGALLY in the state of CT. ALL REPTILES HAVE BEEN DROPPED FROM THE BANNED LIST OF HR6552.

I am not an attorney, but I do have quite a bit of experience with this kind of stuff. This is my reading. I know it is confusing the way CT handles amendments. When they update the HR6552 document with all the new amendments it will be much easier to read. We will soon put out an email blast that will explain how the whole thing unfolded.

I would like to express my appreciation to USARK for its work concerning Connecticut. It is truly monumental that we the reptile community have a group that is organized and in place for the purpose to defend and speak up for us. I am impressed with the professional manner that USARK conducts these time consuming legal battles. The war is on going but at least now we have a reptile voice.

I encourage everyone to get involved and support USARK. One of the best things about USARK is that it is relatively new. Members can get involved and work towards addressing issues they feel are important much more effectivly as a member than just looking in from outside.

the Connecticut ban got my attention,

I am in CT,

Tracy Barker told me about the situation before it was mentioned on the forums. I would like to personally thank Tracy again for the information and for taking the time to read over the phone what she found regarding the issue. Tracy stopped what she was doing at her facility and looked up the information on the internet. I am sure she had plenty of other things to do and if that were not enough she then emailed me the link along with the list of representatives that were involved.

Thanks Kyle, I just saw this and I'm glad that USARK and individual herpers could help and that things moved forward. Everyone really needs to be checking these issues throughout the US. Future endeavors need to be worked on State by State, County by County!

I hope this bill doesn't put more ideas in the heads of the numb nuts in Albany or NYC. They did enough damage the last time they voted on an animal bill, but left the carriage horses in central park alone, since it's a big revenue source for the "tourist" morons.
