Encounter last week with State Troopers

1snakeman1 Sep 24, 2009 10:39 AM

Last week I was in terlingua and saw State Trooper all over the place. At about 8:00 I was gasing up and saw 4 state troopers heading into the Park, two state troopers heading up the 118 towards the Christmas mountains..I asked the store owner what was up and she said they were in the area because they havent been down here in a while. I headed for the River Road and on the way passed another State Trooper in Lajitas and then passed two more as I drove down the River Road...At the windmill turn around point I was followed and pulled over by undercover officer who asked what I was doing because he said they never see any one out there late at night and when I told him that I was shooting pictures of snakes and wildlife, he said that I could be doing that in Califorinia.. He ran my drivers license then asked to see my pictures that I took because he was "into that kind of thing too" which I showed him and then he said be careful and I was on my way....

The next night I was crusing the River Road again and a State Trooper whipped around and starting following me....I suddenly saw an atrox and pulled over. The Trooper pulled in behind me and turned on his white over head lights and asked if I needed any help and i told him that I pulled over to take some pictures of the snake...He held his light on the atrox for me while i shot the pictures...We talked a while about snakes and he told me that the night before which had a little rain earlier in the afternoon, that his friend in another Trooper car had seen an alterna. He seemed pretty cool and asked me if he could go ahead of me since I was driving slow looking for snakes, which I said fine of course....Then about 150 yards from where we had just talked there was a freshly hit 3 foot atrox, still wiggling and then about a quarter of a mile down the road from that hit snake, we saw a 3 foot black tail freshly hit and wiggling....No one passed us at all so this State Trooper that i thought seemed cool, turned out to be not so nice and was purposely running over the snakes so we couldnt take any pictures of them.....This again, is showing us that the law enforcement doesnt care about the snakes or even this law!!

That is absolutely horrible! To deliberately run over these beautiful animals just gets me thinking how absolutely cruel some people are. It makes it even worse when it is a person who is supposed to uphold the law. I just don't get it, really, when there are more important issues in the world to be concerned about=(

I spent a good amount of time on RR over the last month, due to bad weather in the Davis Mnts. The increase in DPS traffic didn't happen until after there was a big bust of a truck coming out of Presidio, by the Presidio PD.
Unfortunately, that is not the first story I've heard of LE going out of their way to run down snakes. In 2007, I had my fuel pump go out in Iraan. The mechanics told me how they had to repair/replace a tire on a game warden's vehicle because he blew it out going OFF the shoulder to hit a snake.

It is interesting that we all get up in arms when pulled over by law enforcement and accused of all sorts of criminal activities we are innocent of. I have had LE accuse me of poaching, smuggling illegals, smuggling dope and scoping out farm houses for robbery all while I was just looking for animals to photograph. It pisses me off when people who have no idea what I'm doing or thinking accuse me of wrongdoing.

We also adamantly stand on the position that any LE would have to prove that any animal found in our vehicles while we are out taking pictures was illegally collected.

We really hate it when LE make assumptions about our activities and motivations.

Yet we are the first ones to pile on when there is an unfounded accusation that this State Trooper deliberately ran over snakes just to spite a herper? There are three assumptions here. First of all that he saw the snakes (LE often drive with lights off out there) and then that he deliberately ran them down and third that he did it to piss off the herper.

He didn't assume your story was a ruse to pick up bales of pot out of the river. It seems you don't offer him the benefit of the doubt that he gave you.

Just trying to see both sides.

I Wondered if maybe he did not run them over on purpose, but instead was just not looking for animals on the road at all and never even noticed????

You do have to remember you are looking for animals on the roadway as you drive, most people are not. Now if he had to get in the opposing lane or off on the shoulder I would vote it likely that he was trying to do it. Otherwise, like most non-herpers, he most likely just did not care one way or the other and did not even notice what he was doing at all.

I've seen herpers run over snakes WHILE looking for them LOL

I've accidentally run over a couple, and it stands to reason that I've run some over that I was not aware of.

Unless he was observed swerving out of his lane to intentionally hit an animal he deserves the benefit of doubt.

If every single reader of this forum gets off his lazy ass (including the ones hiding behind scientific collecting permits) and goes to meet with both their Representative and Senator, writes them a check to support their reelection campaign, and lobbies to get this law changed then you might get your wish.

Unfortunately the odds of me winning the lottery are better than that happening.

You don't have to like me, you don't even have to join HCU, but apathy is going to breed contempt and I won't apologize for it.

I'm NOT talking about you Lance - If everyone put forth as much effort as you we wounldn't be having this conversation right now.

If we get this fixed in the next session will you put on the baggy pants and run in place in front the Outback doing the hammer dance with Everything in place...?

I know I would want to video it.... and we need to I am sure that you could get some backup dancers. Think about it, if you are laughing to tears thinking about it, it will leave a huge impression if you promise to do it and then hopefully have to do it...
