5 gallon idea...

does anyone know of a toad i can house in a gallon tank that does not need a big section of water and can be okay with just a water dish(2 inches deep 5 inches all around, its square.

You can house a juvie PacMan but once it starts to get close to adult size you'll want to move it to at least a 10 gallon.

While a 10 would be a much better idea, there are a few species of toads that don't get very large. I had an adult female black toad (Bufo exul) once that was only about 2 1/2" long. Oak toads (Bufo quercicus) rarely exceed 1 1/2". They are the smallest toads in north america, and, are diurnal, so you can see them out and about duing the day.

I'm sorry, I almost forgot. A 2" deep water dish would probably be too deep for an Oak toad. About 1/2 to 1" would be better. And make sure it's easy for him to get in and out of. They prefer sandy soil, too.
