S373 clarification

If the ban passes and all species of python get banned from import / export / interstate travel does that mean they can still be bred and sold in state? I'm in NC, would I still be able to breed them and sell them to other folks in NC?

NO-as "injurious species" under the Lacey act, breeding will be prohibited.

Yep, one day very soon we may all wake up to find our snakes suddenly valueless....

The Lacey Act leaves it to the states to handle the injurious animals as they see fit so it would become a state issue. You would still be able to breed and sell animals in your home state unless your home state chose to ban those activities.

The following is from the FWS website:

What Does It Mean When a Species is Listed as Injurious Wildlife?

Species listed as injurious (including their gametes and viable eggs) may not be imported into the United States or transported between the continental United States, the District of Columbia, Hawaii, the Commonwealth of Puerto Rico or any territory or possession of the United States by any means without a permit issued by the Service. Regulation of transport or use within a State is the responsibility of each State. Possession of a species, within State boundaries, is also the responsibility of each State and is not regulated by an injurious wildlife listing.

You're right-though I've read in several places that breeding is banned, I can't find it on the FWS site in the actual regs.

....the notion that all breeding would be banned stemmed from the fact that most breeders sell their offspring across state lines (either via the internet or attending shows). Therefore, it would, in effect, hurt breeders significantly. I came across that website the other day while trying to better understand what all this would mean if it passes. I'll keep fighting the fight until the end but I have to admit I am losing hope.

How would the status of S373 victims relate to the current status for the Eastern Indigo and Indian Python? I suppose both of those are restricted as endangered but are the restrictions the same?

If it does come to that I guess we can do our best to try to get every current mutation in every state ahead of the ban and facilitate as much in state production and commerce as possible to keep the populations going. Maybe Kingsnake could set up a state by state registry and facilitate swaps. We should work together to decrease our chances of any mutation going totally extinct while we hope for a change to a less restrictive government. Of course governments tend to take rather than restore freedoms so it might be twice as hard to get back a liberty than keep from loosing it in the first place.

I came to understand that any animal added to the Lacy Act will be completely shut down. It will be illegal to:
Import
Export
Trade
Sell
Transport across state lines
Breed
Abandon

However, THIS is the section of the Title 18 that Pythons are supposed to be added to and it appears to only discuss Importation and (vaguely) Transportation.

An animal listed as "endangered" can only cross state lines on breeder loans, donations, Money can NOT chnage hands. Animals listed as injuries" sp can NOT come into the country, but are regulated by the states. Ringtail cats Native to Texas, farmed from the wild with proper permits are sold all over the country, but are prohibited in some states do to being listed as injurious. Remember the SARS deal years back? All animals under the family viverdia where prohibited from importation into the country. The ones in private collections where sold like business as normal. The Lacey Act and the ESA all do the same the thing. They try to baffle you with Bull $hit !! Most individuals who have fought the gov on these where at a loss to start with. The acts are very vague and open to interpretation. They really read like poor stereo instructions.

Even if we are allowed to breed and trade in these species inside our own states, how will this leave us people in South Florida? Will Florida strengthen its laws about Reptiles of Concern as a result of this new federal law?
