Litigation possibilities against S373?

CaliRepGuy Dec 10, 2009 11:56 AM

I'm not a lawyer but I would guess that we may have some right/ability to bring litigation against someone? The HSUS, the USFWS, The government? At least something that burns their time, money, resources and brings awareness to our fight.

Or the technicality thing mentioned in the previous post? Color and pattern morphs, hybrids, subspecies?

do you have any idea how long it takes and how much money it takes to sue the federal government? this industry doe snot have enough of either. you have to focus now on getting democratic senators to leave supporting this bill. That is the way to defeat this.

Yep, and unfortunately this subject is not important enough to any of them to dare cross party lines. I think it's over guys. This is why it is never good to have one party controlling everything.

actually if you have been wathching what is going on with Afghanistan and with health care the democrats are all over the place right now. Even if only a couple were to drop support of this bill that have no interest in it and no investment in it, that would give opposition to it a foothold which is all we really need right now. If you can say "senator so and so does not back this bill" it goes miles beyond a bunch of people complaining to office staffers. Keep in mind most of the senators do not know anything about this bill, will never read the whole text and do not understand what the issue is. They will vote on it as part of a group of bills and if they see it split down party lines they are more likely to vote it on. If there are cracks in the party blocks it changes everything and they will be much more open to their constituants concerns.

I have done everything in my power to stop this bill. I will continue to do as much as I can. I just need info and suggestions, not pessimism please. I am trying to open up dialogue in order to produce ideas.

If it passes then we will need suggestions on how to get around it. Technicalities, litigation, whatever!

I am looking for replys to this post that contain ideas, info and suggestions.

Thank you

Kevin

if you have a democratic senator contact their office and try to get through to them or set up a future call with them to try to politely and calmly influence their upcoming decision on this bills passage.

keep in mind as well that the most powerful thing going for us with democrats is the fact that they have been jarred by the recent republican governors victories in the east. With the next election cycle being the primary concern for most politicians it is never a bad thing to play on that.

This was a witch hunt from the get go and they've got their witch. Still a possibility they don't pass it or it stalls out but unlikely. If it does I'd love to see the big snake people file a class action for breach of jurisdictional authority or something. In the mean time respectfully get into their face and let them know they are being spoon fed a bunch of BS - its not over till the fat lady sings.

FYI.... You Cant Sue The Fed Govt

CaliRepGuy Dec 10, 2009 12:53 PM

I believe that you can bring litigation against the Gov for breach of rights?

BuzzardBall Dec 10, 2009 03:07 PM

FYI, yes you can! I know someone who did... AND WON!

Its not the end, but its just the start. Many crazy things come out of the senate including harry reed. The bill still needs to be voted in by the senate, then passed off to congress, and then to the prez. Dont let up now, the real fight has just started.
