I know they are illegal if they are under 4 inches, but I have a baby that has swollen eyes, occasional open mouth breathing, doesn't seem to be eating, constantly basking.

Sounds like respiratory, what are your cage temps and how often is your tank cleaned?
If you are under 18 they are illegal in most states but for an adult they are not legal to own. Yes take it to the vet
so shots can be given.

Its not illegal to own a turtle under 4 inches unless your city has special restrictions. You can get small turtles legally by catching them yourself on your own property as long as they are not endangered species or otherwise protected.
