Can I take a sick red ear slider to vet if under 4 inches?

I know they are illegal if they are under 4 inches, but I have a baby that has swollen eyes, occasional open mouth breathing, doesn't seem to be eating, constantly basking.

Illegal to SELL at 4inches not to own. Yes you can bring him to the vet just don't try to sell him to the vet!!
