Supreme Court Gun Ruling

jscrick Jun 28, 2010 07:29 PM

This ruling closely follows somewhat the argument that most of us have regarding the banning laws for reptiles. I think there are reasonable similarities.

Waiting for a video on todays PBS Newshour segment, but here is the link to The Newshour for now. Some info.

Amazing that such a great ruling can come from the same court which gave us some of the amaqzingly bad rulings of recent years (e.g. "Corporate Personhood)....

Similarities between gun rights and reptile keeping rights, admittedly no 2nd Amendment issue with reptile keeping, but the opposing strategy as characterized by Wayne LaPierre in the interview was very similar to what is happening to herp keepers now.

Not a self defense issue, but a "man's house is his castle", 4th Amendment, "reasonable expectation of privacy" issue. And possibly a 9th Amendment issue.

John & Brad,

And throw in the 5th Amendment (private property)...

What's interesting that it was a 5-4 decision! One more Supreme like Ginsberg, Soto-Mayor and now Ragan and it’ll be a 4-5 decision to reverse…Remember it was this court just a few years ago that rendered a 4-5 decision to reverse eminent domain…Which required congressional action (as specified in the Constitution and described in the Federalist) to overturn the Supreme Court’s decision…Because it was congress that acted, the eminent domain case cannot be reversed (prevent future action under the same legal precedent) and therefore, the government (local) was able to “take” private land for tax purposes (ncreased revenue of business taxes versus property taxes)…

The Founder’s put the 2nd Amendment there to ensure the 1st Amendment…

Later,
Jim.
