Snake's value compared to rare jewel

BRENTWOOD – The theft of a rare snake worth $10,000 led to the conviction of a Haverhill, Mass., snake dealer who bought the exotic Axanthic killer bee ball python for roughly $500.

"There is only four of them in the world," Assistant County Attorney Jerome Blanchard said of the snake yesterday. "One of them sold overseas for $10,000, so it's at least worth that. Maybe more than $10,000."

Scott Seavey, 38, of Haverhill, Mass., was convicted on Thursday in Rockingham County Superior Court on a felony count of receiving stolen property.

Jurors in the case had to learn about how a coveted snake wound up created in New Hampshire, after the victim, Kevin McCurley, spent eight years genetically designing the unique kind of python by tinkering with recessive genes.

McCurley said yesterday the success rate for breeding such a snake is exceptionally slim.

Stolen last year, this exotic Axanthic killer bee ball python has an estimated value of $10,000.

Before the theft last September, he sold one of the four pythons to a reptile dealer in England for $10,000. That store, in turn, sold it to a private collector for $15,000, McCurley said.

McCurley had to aid Hampstead police in searching for and handling the snake late last year when detectives executed a search warrant at Seavey's business, CV Exotics in Hampstead.

"It was a great relief once we saw it," McCurley said yesterday. "Once we realized it was stolen, I thought it could have been anywhere."

During the trial, Blanchard had to explain to jurors the value of the python in the world of snake collecting.

"They're all the same snake, but in 20 or 30 different colors," Blanchard said. "It's like a car with 50 different paint jobs, but in this case you're dealing with four recessive genes."

McCurley's snake, which has been back in his possession since it was found, did not make an appearance in court. Blanchard used a chart of different pythons instead.

McCurley, owner of New England Reptile Distributors in Plaistow, had an unusual role in the trial, being both the victim and the state's expert in the case.

"I really, truly tried to be unbiased, even though I was the victim," McCurley said.

Plaistow police were called to McCurley's vast shop, located on Route 125, in late August, about two days after the snake was stolen.

Joshua Rogoff, 29, of Haverhill, Mass., who frequented the store because his girlfriend worked there, eventually admitted stealing to the snake and selling it to Seavey. Rogoff pleaded guilty to misdemeanor theft and was sentenced to 60 days in jail.

Seavey, a former apprentice of McCurley's, claimed to Plaistow police that he did not know the snake was so rare, according to court documents and prosecutors. He made that same claim at his trial, in which a jury convicted him after hearing testimony from several witnesses.

Seavey is scheduled to be sentenced Dec. 10 on a felony charge, which is punishable by 7 1/2 to 15 years in state prison.

McCurley, who has been a victim of employee theft in the past, said he worries that Seavey could walk away with a light sentence because people do not understand the dollar value of the snakes he deals with.

"If I had a jewelry store and lost a specialty diamond -- say the only one in the world -- that is something people would understand," McCurley said.

He said he plans to speak in front of the judge at the sentencing hearing to lobby for a sentence.

You did not miss a thing..... hard to explain this stuff to people that don't understand snakes and the genetics...

I tried to explain Co-Dom(incomplete) and Simple recessive. The simple recessive was easier for them to understand as I used blue eyes in people as an example. I think they retained the Simple Recessive part and lost the rest.

I basically said it was like having 4 things hit all at the same time.

now that the trial is over -- do you believe that Scott ending up as the purchaser was a coincidence?/ Was there any evidence that there was a pre-existing relationship between Joshua and Scott?

Bet your glad that it is all over... except for the CRYING/SENTENCING!!

Small breeders like myself don't even realize that large breeders have to watch their own backs even with employees. Why steel a snake? I mean really, common!! People who do that do NOT respect the hobby at all. I think those guys were in "cahoots" with each other. He said, "go get me that snake and I will pay you 500 bucks to do it. NO ONE WILL KNOW IT WAS YOU, I will say it was me..." HAHAHA.....YEAH RIGHT!!! ROAST EM' BOTH!!!

generally they have bit more of a neck stripe but now always... but yeah.... leaning towards Lemon.

Who did it?

Josh met Scott. Josh told Scott he hangs around the building. Josh says Scott said if you ever get any cool ball pythons let me know, I'll buy them. Josh is like...what kind of ball pythons? As in, does not know much of anything about ball pythons... Scott names morphs he would like... one being any killer bee stuff.

Josh steals Axanthic Killer bee and brings it to Scott. Scott tells him what it is worth and will pay half. Then shorts him $100.00 and gets it for $400.00 Tells him he wants more....

Josh gets the courage to come back days later to see if he has "room" enough to steal something else..

We see him coming and sit him down and he spills the beans.... tells us all and is shocked to hear how rare and valuable the snake is.

The rest is history....

One line of Scott's defense was to "suggest"(STRONGLY!!!) that I set him up to reduce my competition... Get him to buy the stolen snake and not get it back for around a week after it was taken...

and hope he would be convicted of buying a snake that looked like a Bumble Bee..

Did you know the moon is in fact made of Cheese... I heard this kind of logic at the trial!

I really appreciate your reply, and I am glad it is (for the most part) over.

May I have your blessing (considering the devil WAS an angel at one time..lol) and call this girl a Lemon, or would you rather I did not? No hard feelings either way, I would understand if your answer is no, but just thought it would be courteous to ask.

If Kevin says she is a lemon, then I have no doubt she is from his line. Even if she is twice removed..lol. Especially if he is willing to put his reputation on the line in allowing me to call her one. If he said that he would rather me not call her a lemon, then I wouldn't, end of story, but he didn't so. If she throws ugly pastels, then I will NOT call them lemon, but she is smokin' so I have absolutely no guff with calling HER one.

NO!!!! Not at all....he told Josh ( Who is basically clueless about ball python mutations) what mutations he wanted and would buy. Josh remembered the name "KillerBee" and snagged an
Axanthic Killer Bee ( Gee, a serious upgrade) ) One, that he had seen on a tour. He left NERD and went right to Scott's place. Scott told him it was only worth $1,000.00 and would only give him $500.00. Scott went to an ATM and said he could only get $400.00 so that was the selling price. Josh was here because his girlfriend worked for me in my retail store and we never worried about him sneaking upstairs to steal snakes. He would hang around and I did not have a problem with him. We got him on video stealing the snake and we were shocked to see that it was him. When he came back to steal more to sell to Scott we grabbed him and he sang like a Canary. He was actually pissed off Scott lied to him and said it was not worth anything...well, not much.

Scott's defense was simple. He thought it was a Bumble Bee, he could not see the difference between the Axanthic Killer and the Bumble (which he breed and was selling for around $1k). He did not know Josh, everyone is lying, I bribed everyone and made them lie on the stand. His employee( then, was there for the transaction) even had damming testimony said Scott knew it was stolen, he knew what it was and he would not give it back and would "kill it before he ever gave it back." He was very excited to have the snake and the night he bought it he was on my site looking at Axanthic Killer Bees! He was bragging to people what he would breed it to and all....

So much more to this story and my relationship with the little fella....

The snake is much better than a diamond. The value of diamonds is artificialy inflated by a handful of European corporations that control the mines in Africa and buy up everything that comes to market and then stash them and just sell a trickle to the retail markets. Diamonds are actually one of the most common minerals on earth, the Dutch just do not want you to know that. Sorry, I know it is a bit off topic but it is just funny to me.

He knows mutations and there is a history of him selling designer mutations. The DA saw all this but the case was so straightforward that htey never had to use any of it. The trial took 4 days to complete... a HUGE use of Court resources and time. His sentence should be stiff just because he would not admit to anything and forced the long arm of the law to bore everyone with "snakes". 13 people in that Jury...... It was quite a show...and lots of witnesses waiting to give testimony.. waste of time. At least Josh admitted guilt and was sorry. I do not hate him, he just made a few bad decisions but I believe he was sorry for what he did.

I used the jewel analogy to create a parallel that people may understand a bit easier.

I don't know if you can really say that...
some people have good luck with first time breedings and that's how they get into it. I keep reading about people making some CRAZY stuff their first season.
Some of us start with pastels...while some go out and buy a few more expensive things and start that way.

he will get probation, community service, maybe a month in jail...if this is his first offense. I had a friend get killed by a drunk driver...it was the driver's 4th DUI...he got 4 months and his license took away for life....More times than not the punishment DOESN'T fit the crime!

well as far as i know he will continue to stay open under some other people. Even knowing he was convicted he in all reality did nothing that the other big breeders have done in the past he just got caught.

That's so inflamitory and downright wrong! I personally know many who are very honest business people. I'm sure, as vocal as this reptile community is, if there were others it would be posted all over the forums. While I've seen and heard the rumors about a few in the years I've been involved, it has been a very, very limited number.

I hope I misinterpreted your remarks.

I am not saying they all have done it, but it goes down lets bring up an instance 1994 Bob Clark had albinos stolen first ones produced they ended up beig bought by another breeder not using any names but nothing was done so it happens more often than you think people just do not get caught. bottom line people are greedy.

The thief INSTANTLY admitted his part once he got "cornered". He plead guilty, was co-operative and used as little of the local police, jail and court system resources as possible. The "little fella" on the other hand denied any part of anything, suddenly did not know anything about ball pythons and rare snakes. Did not know Josh, did not know the difference from one mutation to another. Did not know why his surveillance tape he admitted to the Assistant DA was in three segments with chunks of time and video missing???? The entire process was like pulling teeth and the defense was to blame others for a variety of things.

One witness that saw the sale was asked if they were at CV Exotics to "Do a drug deal"?????????????????????? There to sell Marijuana Cigarettes???? You know, "oh look, damming testimoney from you...let's ask you if you are a drug dealer going to a reptile shop to sell drugs."??

His response was " I think you have me confused with someone else"! He told the court what he saw and heard, the truth hurts. Of course he was asked if I bribed him with snakes... it seems I tried to bribe everyone with snakes so they would lie on the stand. I hope the DA and the Judge like their new BUMBLE BEES!!!

The process was long, involved and many people had to have their lives effected by this. So in a way i understand why he would get a stiffer sentence...

They offered him the SAME plea, just admit you did it... Get a misdemeanor and bit of time served and you are done.

Nope, would not take it and had faith in his version and now he gets a FELONY conviction!

In my puny mind it makes sense, uncooperative equals a stiffer sentence if we have to work for it!

I'm so sorry you had to go through this, but I'm glad that the thieves got caught. It's unfortunate, but you handled it well.

I had to check out cv exotics after hearing about this. He has some pretty expensive morphs for sale. He definately got what he deserved. There are always a few of "THOSE PEOPLE" in every reptile community. I Do feel sorry for his kids though.
