Genetic Guarantees...

586adan2002 Nov 27, 2010 02:52 PM

Genetics Guarantees and / or E mails with the Genetics . Do they or would they stand up in court if the genetics dont prove out ? Like if something suppose to be 100 % het and you put it with a visual, and you get norms.

I guess it would if you could find a court willing to mess with it and you produced enough to justify that it wasnt a het....but could just be bad luck with the odds of hitting the morph.
Keep in mind if the male was the het and you ran him into 4 female visuals at once and got 20 eggs and didn't hit the morph even then it may still be the odds.

I knew a guy who had 28 eggs from a spider to normals and ended up with TWO spiders!

You might be a ball python fanatic if you subconsciously convert the price of virtually everything in to units of piebald ball pythons

wow...the "snake gods" must really not like him.

Dragged in to this? J/K & lmao.. that was an aggrivating season to say the least! This year was much better tho lol! I have had ZERO trobles producing visual to het tho... I even proved out 2 poss hets this year But the odds gods can be fickle!

It would be easy enough to argue that the eggs did not come from the "het" unless you wanted to pay for DNA testing of all the offspring to support your claim.

That is why you don't just bie from anyone . you need to do some checking into there sale history .

lairofdragons Nov 27, 2010 11:26 PM

Even if you buy a het from a well know breeder and someone with a good rep you still would have no grounds to stand on even if it didn't prove...
The law of genetics works off of a 32 offspring possibility but it is just that...still a possibility. Yes the law says you breed a 100% het to a visual for the same gene the "law" says you should get 16 of the visual but that is not a guaranteed...its just the average we hope for and base our hopes off of...
truth be said you could cross a het into a dom or a normal to a dom and produce 100's of babies and never hit what you are hoping for because it is not for sure..if you want a guarantee dont play with hets or your only choice is deal with the odds...
that just my opinion and I could be wrong but I don't think I am.
I would be curious to hear other opinions on this subject...

PROBABILITIES, not POSSIBILITIES. A probability is a quantification of the possibility.

There are no guarantees in genetics. The percentages are based only on probabilities. Each egg has the same probability of coming out as any of the possible combinations.

So in other words, anyone can get scammed and the courts wont do anything about it ?? Is that what you guys are saying ? I think you guys need to grab some law books and do some research !

chongorojo Nov 28, 2010 09:41 AM

I don't have a law book.. but why don't you reference us a good example where the courts paid off a possibility of producing a genetic morph?

586adan2002,
You must have a reason to be asking this question and getting a little defensive to the answers you are reading....I would guess you had a het that didn't prove out and you want to know what can be done about it???????

I guess you could find someone who will preform DNA testing on the parents, pay for DNA testing on the parents of the snake that produced the het and have the het tested then get a lawyer, present it to a court and see what grounds you have to prove that you were mis-represented in you purchase from the seller of the het.
Should only run you a few thousand dollars to pull it off if it can be done at all.

Not to mention, make sure you've bred the animal enough times to have really covered your bases in proving it out AND make sure you have pictures of ALL the breedings in your collection, AND find a judge who is actually going to be able to differentiate between the snake you're saying was supposed to be a het, and whatever other normal ball pythons you have. My wife sees these things everyday and can't tell the normals apart, and I would be willing to bet that any judge this case happens to land in front of, will not be so well versed in ball pythons. And even if it did go to court, and you did win, in theory, all that could happen is a judgement placed against the defendant...and I've seen plenty of people never see a dime from those judgements....all in all, good luck, and buy from reputable breeders.

mykee Nov 28, 2010 12:10 PM

Don't trust the breeder they came from?
Why did you buy from him?
Avoid this whole problem by only buying hets from reputable, responsible breeders with good reputations.
More often than not you get EXACTLY what you pay for.

It really comes down to the willingness of the seller to back there claims as a ----% het and what they are willing to do about it.
