Anybody seen the ad for those Nike Zoom shoes? Wondering if the snake in the ad is a Mex Black or a Black Pine. Snakes and hoops, can't get much better than that.

We had some comments on the Indigo forum about that add. I think it is a L.t. gaigeae, a Black milk. Scales look smooth and shiny, head narrow, so my first guess of MBK I think is wrong. I will go with L.t. gaigeae, what say others?

Well, it's hard to make it out real well in that pic, but the head looks a bit more distinct from the neck than gaigeae generally are. The scales don't look "quite" as large as gaigeae either. Snout tip pretty much looks nigrita as well, including the small light-colored flecking on the "mental" scale just below the tongue opening. And of course, MBK's are still more commonly seen, which would make them a bit easier for idiot's like those to get their hands on.

But regardless of what type it is, Ya know, it is only TOO DARN BAD that the stupid swimming pool WASN'T filled to the brim with real Black Mamba's!!!!

Each and every one of those moron's should get punched right in the head, then carted off to jail for their abusive participation!

MBrawley, you might want to re-read CPC 597(c) before approaching a DA or anyone else likely to try and prosecute such a case. A key phrase and challenge to prove ..."maliciously and intentionally...", this case requires the state to prove the intent. A defense is "we are just ignorant folks, we did not intend to hurt the snakes... and they seemed just fine when I got out of the pool..." In a world with overwhelmed criminal justice system, this case would not likely get off the DA's desk...the elements are lacking. A professional wrangler, many of which work for Hollywood contracts probably made a lot of $ off this footage, and the best thing to do is contact NIKE and anyone else associated with Kobe endorsements, tell them how offended you are, and most important, don't buy the product he is endorsing and tell the manufacturer why. It's all about $...

I see your point, and can appreciate your response...however, these dumbasses' intent is implied. NONE of it occurred by accident. It was INTENTIONAL, and ANY reasonable person (and THIS, is the standard-ANY REASONABLE person; one DOES NOT have to be a veterinarian or other expert to foresee the results of this stunt) knows that a 180 lb man jumping a bicycle onto the back of a small animal is absolutely, without question, going to result in serious bodily injury and or death. And besides, PC597 is a GENERAL INTENT crime. This law does not require them to intend on injuring or killing these animals. The elements are there. And ignorance is not a defense.
You are correct as it relates to the DA likely not filing a formal complaint. It's a "stale" case by now, and provokes no significant public outcry, and ultimately, does not "shock the conscience" of "the people", whereas there's no real demand for action to be taken by the DA's Office. After all, they're "just" snakes. I'm telling you, if they were kittens, or even hamsters, the DA would feel more compelled to at least review the case. But not for snakes or other creepy crawlers. This IS animal cruelty though and the elements are there. All you have to do is look at the totality of the circumstances. These guys did not have to intentionally cause harm. Their willful actions and wanton disregard for the welfare of these live animals, no doubt led to several animals being seriously injured or killed. Case closed.

I did not intend to start this type of debate and am not interested in getting in to all of the technicalities of this type of case. To me, that's not the issue. I do however, 100% agree with your suggestions. Hopefully others will too. Admittedly, I was pretty heated, earlier this afternoon, when I first learned of this. I've cooled off since then. And besides, it seems to be "old news" by now. I know the DA's Office of whatever county it is, ain't gonna give a #*@&, nor will anyone else for that matter. I've seen cases WAY worse than this, that ultimately resulted in a "dismissed in the furtherance of justice" or "insufficient evidence" disposition. Oh f'in well. Life goes on and so does this type of ignorance. Not much one dude can do about it.

California Penal Code 597(a) - Cruelty to Animals. "Every person who maliciously and intentionally maims, mutilates, tortures or wounds a living animal, or maliciously and intentionally kills a living animal, is guilty of an offense punishable by imprisonment in the state prison (meaning a FELONY!) or by a fine of not more than $20k, or by both, the fine AND imprisonment..."

Now this particular offense is commonly referred to as a "wobbler", which CAN be reduced later on to a misdemeanor, depending on how spineless the county's District Attorney's Office, and the Deputy DA who's assigned the case is. But regardless, "wobbler" are ALWAYS treated as felonies at the onset of the criminal investigation and judicial proceedings.

Translation: These $#^&$#*&$@ $%@*$@*&$@% dumbasses actually videotaped themselves committing felonies, and put it on YouTube. Damning evidence. They, at the least, should have criminal complaints files against them. There are NO provisions in the law that allow celebrities and other ^%&^$@&^%# &$#&^%* seeking their 15 minutes of fame, to do this ^@%#.

How many of those poor snakes came away from that with broken or severed back bones and spines, ribs, and other internal injuries? How many are now dead as a result, or are still injured and sufferring?

I can tell you one thing, had I been there, there would have at least been ONE guy getting hooked and booked that day...ME!!!!!! I have ZERO tolerance for cruel hearted, mean, abusive, showboating $^#*(%(* $^$(#^ $^(#(*$^%#*# ^(#$%(*$^%# like these guys.

Whether the deputy DA's, and/or DA's Office likes or dislikes snakes is a non issue. They are obligated to review this case, just like any other criminal case presented to them, regardless of any personal bias. Aptly stated about the double standard w/ animal lovers favoring all the cute and fuzzies over snakes.
The ad I was referring to was a single snapshot of a snake and a pair of shoes. Never bought Nike cuz I couldn't afford it. My court shoes are a pair of $35 Proteges (Please don't tell me the co. that makes them is a subsidiary of Nike).
