Eastern Garter with head/eye trauma

I found an eastern garter on a bike trail yesterday, when I found him he was laying pretty limp and didn't really react when I touched him, today after warming up in the sun he seems better, his eye is still full of blood and pointed downward..
other than his eye he looks to be 100%, I think he may have a little brain damage but he still gets around and uses his tongue
should I release him where I found him today?
(we dont have any snake rehabbers around, and snakes aren't allowed in the house(mom))
so what do ya'll think?
