The selling of Turtles in Canada?

I know that turtles cannot be sold in stores in Canada, but can they be sold by someone who had the particular turtles from before it was illegal to get them in stores?

We found our turtle at a pet store in Oshawa about a year ago and hvae since seen them at SuperPet and PJ's.
