Legal issues in breeding

ekpunobi Dec 18, 2003 09:53 PM

Are there any permits or licenses required to sell bearded dragons or other reptiles? I would assume that each state would be different. I am in Florida. I am thinking about hobby breeding on a VERY limited scale -- like only incubating 5 eggs at a time.

You have to get a permit from Fish & Game. They have raised the price this year so I'm not sure what the actual price is now. Go to their site, download the pdf application, print it, fill it out & make an inventory list, & send it in. It's that simple. You are subject to onsite inspections so I hope you find out all the regs. (also on their site)

Good luck.

In the state of Florida you must have a license issued by the Florida fish and wildlife commission. If you plan to sell the babies it is a MUST! If your only going to be a "hobby" breeder and have one pair and only sell to people you know or through the local paper, you "may" be able to get away without legally getting a license, but Florida law states that you must have a license to breed, sell and show such animals.

My two cents

"Regulations regarding the buying and selling of reptiles and amphibians:
Pursuant to 68A-6.0021, Florida Administrative Code, it shall be unlawful to buy, sell, or transfer any wildlife to or from an unpermitted entity within Florida. This means that you cannot sell animals without a license (see above), and you cannot buy animals from a person who does not have a license. The recipient’s name, address and the license number shall be entered into the transferor’s records and made available for inspection by Florida Fish and Wildlife Conservation Commission employees for a period of one year after the transfer. No person shall possess any wildlife requiring a permit for personal use, or any wildlife for sale or exhibition, without documentation of the source and supplier of such wildlife."

If you do get caught, they can take all your animals and you will have to pay some good fines.... Better safe than sorry.

Later.

I thought you had to have one, but I wasn't sure. I know about mammals, not reptiles. Also, with a permit from Florida F&W, can I sell instate only or out of state as well? Have you guys been inspected? If so, what do they look for the most? My enclosures are always clean and I keep animal food labelled and away from human food with the exception of my fruits/veggies/greens. Is that okay? I have heard that with USDA you need a separate fridge for food designated for animals.

I have never been inspected but I do know people who have. They do have cage requirements listed on their site. I think that & basic animal care requirements are what they look for. I do know that they have added the requirement that you keep records of all the people you have sold to so that's something you may want to keep up-to date.
I see it all as a good thing. If they do inspections, it helps keep the dirtbags who give us all a bad rep. in check. lol Not to mention, it is all for the animals best interest.

Good luck.
