Somebody stole my Cleo

CE Jun 06, 2003 04:55 PM

Somebody overseas stole my Cleo and used her for a logo on their website... that's just wrong! I emailed him... hopefully he will remove it.

I'm just curious, I have no reason to do this or anything, but what if someone approached you about useing one of your pictures? I mean, rather than just doing it, wrote you an email saying that your pictures are great, they really like them, and they wanted to use them on their site? Would your response change if it were for or not for profit? What about taxonomical studies, where they needed really good representations of a certain animal? It seems like with all the great pictures on this board, there's a lot of value (both money value and knowledge value) in images people have posted.

Anyone can answer, I'm not only asking CE.

Since you asked I handle it the following way:
If someone wants to use a photo where I am the owner of the copyright I expect to be asked.
I NEVER rejected such a request so far and I never asked for money. But I want to be asked and I want the credit for the photos. This should be a matter of course and the outcome of a decent upbringing.

I have stumbled across one of my pics on someone else's webpage before...it's a bit...wierd. First I thought, "Hey, that photo looks familiar, where'd I see it before?", then it was "Wait a second - that's MY picture!"

I would have no problem with someone using my photos, provided:
1. I am asked beforehand!
2. Proper credit is given
3. They're not selling the pics

It's not just a matter of politeness; someone taking photos and in essence 'stealing' them for their webpage is in violation of copyright. I think some people are just unaware of that though. I remember someone on one of these forums stating that 'anything on the internet is in public domain', which is patently false.

I have had several people in the past ask me if they could use one of my/our (EBV's) photos on their website. Most people who ask just have personal websites and want to display pictures of either snakes they love or snakes that they have bought from us in the past. Most people who contact me about this will automatically offer to give us credit for the photo as well as put a link to EBV's website on their website. And that's pretty much all I ask, that credit is given where credit is due and a link to our website it nice as well (although not absolutely necessary).

I have come across one or two instances where permission was not asked to use a photo but the person posting the photo bought that actual animal from us and were either showing it off or trying to sell it later on for whatever reason. Those instances are somewhat aggravating and annoying but I generally let it go...

I would of said NO. I don't mind somebody using one of my photos to show an example of BCC as long as they asked for permission beforehand and credit was given. To use it as a logo is totally different story. When I come accross herp sites designed and maintained by breeders I expect every animal on that site to be a representative of what that breeder produces or owns, unless otherwise noted (guest photos etc.. ). Look at www.floridaredtails.com logo.. His logo says it all. Those are the types of animals you can expect from him. Anyway.. no need to argue this point anymore.. dude removed the photos.
