Ripped OFF!!!!!!! What to do?????????????

I have removed the name of the individual and company as I beleive is the rule of this forum.

On 5/7/03 I purchased a male adult albino boa from ***** ******* of ***********. I payed by Postal Money Order. When I recieved the boa I paid $80.49 shipping to pick it up from Delta. When I opened it I was alarmed at how skinny he was(I took a picture). I was actually LONGER than I expected but was skinny. ***** asked me to send an email right away to him stating how it was a great deal he gave me. He told me not to worry about the size and he bred every female he came in contact with. Stupid me actually belevied ***** when he told me he bred 7 females. It was nothing like the picture he sent me of him. I called ***** and told him of my concerne and he said do not worry at he was in "breeding Mode" so he had not eaten in awhile. ***** said he had bred SEVEN females. ***** told me himself he had refused the last two time he tried to feed him. I tried frozen, fresh killed and reluntantly live to try to get him to eat. He never did. I kept on calling ***** every few days and he kepy saying he was in "breeding mode" and he would soon eat. ***** told me to put him with a female and watch him go. Until this point he had been completly quarentined. I AM NOT A BREEDER and I was stupid enough to listen to ***** and put my CB columbian female that I bought in 1994 in with him. They were together for three days and he could care less. AGAIN I called ***** and told him I was not happy. He said not to worry as he would take care of me. After that he would not return any of my phone calls. I continued to send emails and leave phone messages with no answer. At one point the albino passed loose stool and I took it to the vet and found out the boa needed to be treated right away. I called **** and he ACTUALLY answered the phone. He said not to worry as he had a friend that worked for the Smithsonian that could treat the boa. He sent me an email stating he would refund my money( enclosed) but then later changed his mind. I beleive he lied just trying to get me to send it back to him. He told me to send it back and he would nurse it back to health. I called him every few weeks and he said the albino was doing great and it was twice the weight that it was before. I kept asking him to send it back or give me my money back but he kept coming up with some excuse. Finially in mid-December he said he was going to ship him back. At this point he had the boa in his posession for 5 MONTHS!!!!!!!!!!! The whole time he kept telling me how great he was doing. The day he was to ship back to me he said the boa died and he would give me a FULL refund. For the past month he refuses to return ANY of my calls or emails. He has caller ID so he knows it is me calling. Enclosed is a picture I took of him the day I received him (I hope).

*****'s Email stating he would refund my money:

If you believe you were a victim of fraud, and the snake was purchased through this site, then let the kingsnake admin know what happened.

File a complaint with the Federal Interstate Commerce Agency. Notify the seller that is what you will be doing first and see if that does not encourage him to give a full refund. If not, file charges.

Is it against forum rules for each of us to enter a letter of that person's name? I am still owed shipping from an individual and I beleive it to be the same person, I tried for over a year and was actually told money was on the way.Never seen it. Good Luck

If you would like to know who this person it you can email me at mikeyarish@earthlink.net.

I would be against rules to post his name hear.

Since you used a US Postal Money Order to purchase the albino, the ticket stub would have all your info, as well as, his info. If I'm not mistaken, anyone who de-frauds someone who cashes the US Postal Money Order is in essence committing mail fraud, in which case it becomes a felony and local authorities will take action. It's been a while, so I'd check to verify this with the main post office branch in your area to see what can be done. Hope this helps.

I know a lot of you may feel it's immature to act out like that, but some times it takes a good a## whooping to make a low life learn! Not only does he hurt the buyer but also all of us not so well known breeders. No wonder people only deal with the bigger breeders. Who wants to risk their hard earned money on people that are not known that well in our hobby.

I hate a thief!
