No a 40G is too small and possibly too small for one Adult depending on how big he get's. A 40G Breeder is often considered the absolute smallest enclosure an adult can be kept in.
Nice looking BD by the way. I noticed that you have him on calci-sand which is considered by many to be one of the highest risk substrates that you can use. A safer alternative would be children's playsand or Duck brand shelf liner.
