EVEN MORE REPTILE BAN INFO

Dear all:
Even if this bill is passed, all cases of CBB animals can contest the bill. It specifically uses the phrase wild animals for the exotic animals in question, but does not clearly define reptiles and other exotics born in captivity. Although this hurts the importer, and the WC keeper, it aleast saves room for the CBB dealer. I am by no means advocating that one should not write to the Governor of New York, but I do see a spark of hope even if this law should pass.

doesn't the bill say that those who possess the listed exotics are prohibited from breeding them??? It states that you are allowed to keep the animals that you have at the time the bill is signed into law, but not allowed to breed them.

They will not take such a literal take on the meaning of “wild animal”. They will refer to it as “the sprit of the law” Which is a legislations way of saying “ you know what we mean don’t mince words” and then they will take your Captive Born animals and arrest you for violating the ban. It is that simple, if the law is passed the Boa and Python keepers will be out of luck. We may get lucky and find a herp loving lawyer to try and contest the law on individual freedoms, but there is nothing in the Constitution saying that we have the right to “bare Boas”. I doubt that you will even find a lawyer willing to take up the fight. With out the payday being in it for the lawyer there is no reason for them to take up the fight. The court systems are never about what is right, wrong, just or unjust, it is simply a money issue. Criminal and Civil courts alike are a business and lawyers are the benefactors. The same lying lawyer that is defending the drunk that I arrested for DUI, will thank me after the trial (win, lose, or draw) because regardless of what happened to the Drunk, the lawyer made his/her 5K defending the drunk. The outcome makes no real difference. Sure he would like to win the case, that way the Drunk will still have his license and more then likely get arrested again for DUI with in the next six months and again call the lawyer and pay him another 5k. It is all about the money in court and there is no payday for a lawyer to take up a Herpers cause (sorry about the side rant on the drunks LOL).
So you can try and build a case based on your interpretation of the word “wild” but it will never make it before a jury. The judge will deny the motion based on “the sprit of the legislation” and you will still have no Boas.
No the only way to beat this is the same way we have done it time and time again, stop it before it becomes law!

and in the bill it is not defined as CBB only "wild animals". All I am saying is it is possible, depending on the judge, jury, etc..... All I was talking about was simply hope. In anycase, write the governor.

Just for the sake fo this disscusion lets say the origanal poster is correct and because they refered to them as wild captive borns can be breed. The other issue to tackle is they say the animals can not be breed only kept as pets "6. ANY PERSON IN POSSESSION OF A WILD ANIMAL AS A PET THAT HAS BEEN
2 GRANTED A PERMIT PURSUANT TO SUBDIVISION FOUR OF THIS SECTION SHALL NOT
3 BREED, SELL, TRADE, BARTER OR EXCHANGE SUCH WILD ANIMAL."

There is just one slight problem. All reptiles are considered "wild". It doesn't matter if they have been CB for 100 generations.

Did you know that if I had a venomous reptile in a LOCKED cage, with SIGNS posted everywhere stating the dangers and the complete area ROPED off with do not enter signs I'm still responsible if an idiot bypasses all of that and gets bitten? At least thats how it works here in KY. All because reptiles are listed as "wild". Got to love that.

You are right. I just adopted her from Arrowhead Reptile Rescue last Sat. She is 8ft, 3 inches and 25.5 lbs. She is supposed to be 12 years old. I'm going to try to fatten her up some asap. I finally got her to eat for the first time tonight!!!! YEA!!!!

If you are looking for a PET and not a breeder I highly recommend ARR. I cannot say enough good things abou them.!

I'm not sure how much not being able to sell reptiles would hurt their business, but perhaps they could be of some help in this matter.
PetCo and PetSmart are large corporations that would have the finances to fight something like this. If we could convince them to say something, I'm sure it would get noticed.
