Looks to me like a yellowbelly water snake, Nerodia erythrogaster flavigaster, that someone killed by whupping it across the top of its head.

He claimed he let it go in a field uninjured but it looked pretty bad to me too. Of course I'm in Texas so I don't know for sure one way or another.
its not dead or injured .... this is a defense mechanism they flatten out their head and bodies to make themselves appear larger.
I could be wrong, but notice -
>>the unnatural way the rear of its body is bent
>>the top and left side of its head seem slightly caved in
>>the left eye seems to be missing, although the right eye is visible

I know a lot of snakes puff or flatten out to make themselves look larger then what they are but to me it clearly looks like this snake has some massive injury to the left side of it's head. Looks like a hole in the left side of the head to me.
