Radiatied tortoise breeders in the midwest

xturtlepowerx Oct 06, 2004 01:09 PM

Is there any breeders of Radiated torts in Illinois? I havn't come across any yet, I would like to go around the whole having to get a permit because most of the dealers seems be in florida, and the whole crossing state lines thing...

I hope this doesn't come across as hijacking your thread, but I am curious how the permits work for radiateds. If you find one in your own state, you can just buy it without any extra paperwork? What happens if you move out of state, do you have to get a permit then? Good luck with finding a radiated!

You may take it across state lines once you own it just not to buy it or sell it without a USFWS captive-bred permit. You may accept or give specimans as donations across state lines. Govt. wants to limit trade for commerce purposes. That is, individuals who wish to make money off transactions. The process isn't perfect but maybe someday it will be.

NO. Lacy covers transport for "commercial" purposes. That is, some sort of economic benefit. Donations and someone moving are exemptions. I have a CA friend who got a galop from AZ under a "donation" and has letter from USFWS referencing that this is allowed so long as money or other pecuniary benefit wasn't exchanged.

You either have to have VERY generous friends or you have to cover you're tracks pretty well.

If they come after you for using the Lacey act they've probably got something else on you and that is usually a tag on. In that case whoever tries this better be damn sure the paperwork is in order or I'll bet the ca ca can get pretty deep.

I was pretty sure that the law concerned the movement of any dangerous or protected species regardless of if it is for personal or commercial purposes.

After re reading the act I think I was correct. What makes this law scary is that it looks like they can use it on the local level. I don't think you can use a Federal law on the local level but I don't know.

The bottom line is that if you are moving the animal across state lines the burden of proof is on you to establlish the legalities of the origin of the animal IF you are called to the matt.

This is not something to take lightly or act without doing some individual research. A 'clarification' letter from nearby USFWS office would be smart as well.

This law is broken daily and very regularly so it is not hard to get snagged by it.

Any time you ship an animal the container must be clearly marked with the contents and Live Reptile does not count.

The way I understand it the container must be marked with the quantity and the species it contains.

I can't tell you how many packages I've received where this was not the case.
